and HE enters your property, can I legally beat the living snot out of this guy without having any harassment charges put against me in CA?

This in CA. Of course not. If we had texas' castle/domain laws then yes technically, you could rough him up on your property.

Yeah, you can't rough him up. But because we're in CA, if you hurt your fist while smashing his face, you can sue him!

Would not be a smart Idea; more than likely you will be brought in on assault, but if their is no witnesses you could get off; this is CA remember OJ.

no, unless they force themselves inside of your home, and after verbal warning they still do not leave AND they pose a physical threat, can you provoke something. Also, if a guy comes into your house with a knife, and you shoot him with a gun, that is use of excessive force. you can only do just enough to subdue an individual enough to eliminate the threat. once the threat is eliminated, you no longer have the right to harm them, you have to let the cops handle the rest.

i looked into the laws because i ALWAYS carry a knife on me and was wondering if i could legally use it if someone assaulted me.

Self-Defense: a person has to reasonably believe he is threatened with force. Person is allowed to use unlawful force proportional to the threatened force. Deadly force allowed when you reasonable believe that you are threatened w/ imminent deadly force, bodily harm, kidnapping, immediate sexual assault and robbery.

You can use a gun against someone in your home with a knife as long as you "reasonably believe" that you are threatened with imminent bodily harm. It would be stupid if you had to ditch your gun and find a knife to protect yourself. For example, female victim would be justified in shooting a defendant who attempted to rape her in a dark alley even thought he was not carrying a weapon.

If this person you don't like comes to your house looking to cause bodily harm to you, then you should be ok with claiming self defense.
