California DUI Question...?

Default California DUI Question...?

Just got a call from my 20 year old brother. He's currently in Santa Barbara. Last night at 2am he got a DUI while riding his R6. They took his license on the spot and gave him a paper one. Held him for an hour and let him go. He got his bike back, but it cost im $550. My question is, what are the laws regarding DUI'd in CA, and being under age? I'm not very familiar with the CA laws....?

A buddy I work with was 20 at the time, got a DUI out in town.

He didn't lose his license or anything, not even the car was impounded (there was another sober-er driver to take it I guess).

His court **** isn't finalized yet, but he is still from Texas (military) and so is his license, and I guess cali can't take it but can only recommend texas revokes it ??

It will just end up costing him a shitload of money. I don't know I thought it would be way worse but I guess it will depend what state your from, if you are from cali and your license is too, I'd guess your probably screwed.

No college... Here is the story... He had only had 2 beers in the last hour.. and trust me he can drink so he wasn't impaired. He and his g/f had a little argument so he jumped on his bike to go let off a little steam on 154 between Santa Barbara and solvang(sp?) Lots of hills, lits of corners lots of fun on a bike So he gets to solvang and goes to turn around and head back when the blue light come on. He came into town doing 65 in a 50. He gets off the bike everything went smooth, he didn't do anything stupid, the cop had him blow and he blew a .05... not much. But he only has a motorcycle permit..... so he shouldn't have been on the highway any way, whe shouldn't have been riding after dark and I don't think it was inspected anyway... so yeah, he's prob fucked. The little I do know about California traffic laws are that they are not lenient. They only held him for an hour then released him.

Haha, he just changed his license from VT to CA. Oh well it will be a lesson learned the hard way for him

Wow, California DUI laws are strict!

1st offence....

3-5 years of court probation... No probation officer, it just means they will come down on you that much harder if your caught drinking and driving while on probation.

Fines generally range between $1400-1800. This does not include the impound cost of your car/bike

Mandatory 6 month loss of California drivers license... With the possibility of having limited privleges to drive only to work or school.

DUI school. 12 to 45 hours of dui school... Hours needed are based on you bac when arrested (for instance .20+ gets you 45 hours)

Mandatory minium of 96 hours of jail time.. with a minimum of 48 hours to be served continuously.

These are basic minimums, but may vary county to county.

In VT they take your license for 3 months make you go to a quick dui class and give you your license back for first offence.

hes lucky im at ucsb and a student just crashed his motorcycle and died. ca does not mess around because of things like that.

His biggest problem is that he was underage.

Any possibility he can challenge the validity of getting pulled over in the first place?

Did he blow again back at the station? If so, what did it read? Ask for the reading out to the 4th digit.

Have him get his restricted license ASAP otherwise it will compound the problem if he gets pulled over again, this time for driving without a license, and will set a bad trend for your brother.

He will have to pay for an attorney and for the DUI classes. Expect $2500+ after everything is said and done. GET A GOOD ATTORNEY.

I spent some time in Cali and I know of a couple people who got DUI's. He can get a lawyer and get it dropped down to a Wet and Wreckless. The two I know blew a .08 and a .04 both got lawyers and the tickets dropped to a wet and wreckless instead of an all out DUI.

haha, hit me with a stick...

so yea, not looking good? oh, and they held me for a couple hours and then released me to a friend that had to come sign for me. The arresting officer was a really cool guy, but the other officer that showed up must have been having a shitty day...

a buddy here did that also, his first one was a wet reckless got it lowered, basically its like a probationary period i dont have time to go into it now, but ask about it.

DUI laws suck if ur 20 in CA. i have 17 more days till i am 21 and i am ready to drink my .08 legal limit and smash around in my SS... haha

What bad about California is not so much the DUI put it stays on you Insurance for 10Years


I have heard that with Fines,Court Cost,and High Insurance Premiums that a 1St DUI will cost you over $18,000.00 thur this period.
