Default Any Lawyers on here???

I had a guy who "claimed" he knew what he was doing, install heads, cam, stall, Fast 90/90, etc... Well now that I have got the car back I found out that he has royally F****D me! He didnt ground the motor to the chassis and apparently the entire time that the car had been running it was sourcing a ground through the PCM. So the pcm is toast among several other electronic components, because he also put an 18v charger on the car.
I am just checkin to see if there are any lawyers on here and what their take on the issue is. I did not have a written contract with him or anything. Am I screwed or is there a way to get reimbursed for the $1,500+ worth of stuff I have had to have a reputable shop fix. Which by the way I have had nothing but an excellent experience with them. I am definitely going with a shop from now on!!!

Anyone willing to share similar past experiences please share! Or how about some legal advice from a lawyer?

is the guy even licenced? im no lawyer but by common contract law you had a verbal agreement for him to fix the car as is. so you might have something there. but if the guy isnt a licensed mechanic.. then your screwed.

naw he isnt a licensed mechanic. He just told me "Yea I know what I'm doing" and then when I actually take the car to a shop to get it tuned they tell me all of this stuff that is screwed. So I e-mailed him and very kindly asked him to pay for it and he basically gave me the F-U!

I'm not licensed in Kansas so can't give you any actual legal advice (NY/NJ only). However, based on what I learned in law school about how other states work, I would look into the possibility of filing an action in what we call "small claims" here in NJ - they likely have a system like that out there. It should be cheap to file, and though you probably do not need a lawyer to go through the process, a Kansas attorney can give you some guidance. A good one will just tell you the basics of how to do it over the phone, no charge. If you actually hire one to do it, it will make you look more serious to the court system (and the guy who screwed you) too.

i think this is against policy on THIS site to ask for legal stuff....might want to move it to SSU

however i worked in law enforcement and dealt with civil issues alot.....even though you didnt have a written contract you entered into an agreement none the less...if your wanting your money back your going to have to go to small claims court, end of story

yep, file a small claims court case / civil lawsuit against the guy, that's all you can do. even then, when/if you win that case there's no gurantee the guy will pay you.

he used to work at a shop called Excessive Performance. The shop went under quite some time ago. The guy that did the work was located in Grain Valley, MO.

In all honesty I really dont want to take him to court if I dont have to. But I paid him to perform a task, and do it right. While he had the car he put countless scuffs and scratches in the paint, smashed up my custom painted fast manifold, fried my pcm, lost one of my hood struts, and he even refuses to give me my stock parts back until I pay him $68 for fluids. He hooked me up with discounts on all of the parts that I put on the car but he wont give me any receipts because he wants his F'n $68 first.

... lot of (as we say in the Army) 'shithouse lawyers' on here who will tell you just enough that you'll get screwed if you listen to them.
