Default Undercover Cops??

Ok so in my town the cops are starting to crackdown on traffic violations. All of a sudden there are at least 4 undercover cop cars that i know of. The officers wear just normal street clothes and the cars are unmarked. There is a blue crown victoria, silver crown victoria, burgundy crown vic, and a gold ford Taurus. My friend has had a run in with the gold Taurus. So i have heard some rumors that you do not have to stop for an unmarked police car. I do remember a while back hearing on the news of people getting pulled over by impersonators and getting robbed. So what i wanna know is do i have to pull over for an unmarked police car?

Oh and i live in Pacifica. And for anyone who knows Sharp Park Road and how fun it is to drive. I advise against speeding there anymore cops are all over that road. The days of trying to set a land speed record for sharp park are over

I don't know the answer, I could make assumptions both ways, but that's not the answer.

But if you don't pull over, you could cover your *** and call 911, tell them someone trying to pull you over and it doesn't look like a cop car.

Even if the undercover car has all the lights and whistles and you dont feel safe pulling over you can keep on driving and pull in where you feel safe. When asked why you didnt pull over you give them your excuse. Or like mention above call 911. **** now a days you dont know who might be behind the wheel

Yep - I've heard that from a few officers because of the mentioned concern - just give the guy some way of knowing that you plan to stop but for him to follow you. Just find a well-lit place with a good amount of people around.

Ya i would prob just run if it was a Taurus lol but ya the cops in my town are getting desparate.

just call and tell the 911 operator where you are and what the car looks like and that someone is attempting to pull you over, theyll see if someone is in that area and if its legit. i would NEVER just pull over.


or if its night, gun it and get far enough ahead and pull in somewhere and turn your lights off, make sure your not on the brake, ive gotten away with that a few times.

The best way to signal that you are aware that the cop is there and are waiting for a safe place to pull over is to turn on you flashers. As far as is it legal to use unmarked cars, that is up to you state. In ohio an unmarked car cannot be assigned to the road as a traffic unit, but I know Indiana uses unmarked camaros.

VEHICLE CODE
SECTION 2800-2818




2800. (a) It is unlawful to willfully fail or refuse to comply with
a lawful order, signal, or direction of a peace officer, as defined
in Chapter 4.5 (commencing with Section 830) of Title 3 of Part 2 of
the Penal Code, when that peace officer is in uniform and is
performing duties pursuant to any of the provisions of this code, or
to refuse to submit to a lawful inspection pursuant to this code.
(b) Except as authorized pursuant to Section 24004, it is unlawful
to fail or refuse to comply with a lawful out-of-service order
issued by an authorized employee of the Department of the California
Highway Patrol or by a uniformed peace officer, as defined in Chapter
4.5 (commencing with Section 830) of Title 3 of Part 2 of the Penal
Code, when that peace officer or authorized employee is performing
duties pursuant to any provision of this code and the out-of-service
order complies with Section 395.13 or 396.9 of Title 49 of the Code
of Federal Regulations.
(c) It is unlawful to fail or refuse to comply with a lawful
out-of-service order issued by the United States Secretary of the
Department of Transportation.
(d) It is unlawful to fail or refuse to comply with a lawful
out-of-service order issued by a peace officer or commercial vehicle
inspector, of any state, any Province of Canada, or the Federal
Government of the United States, Canada, or Mexico, when that peace
officer or commercial vehicle inspector is in uniform and is
performing duties under any provisions of state, provincial, federal,
or Mexican law and the out-of-service order complies with Section
395.13 or 396.9 of Title 49 of the Code of Federal Regulations.



2800.1. (a) Any person who, while operating a motor vehicle and
with the intent to evade, willfully flees or otherwise attempts to
elude a pursuing peace officer's motor vehicle, is guilty of a
misdemeanor punishable by imprisonment in a county jail for not more
than one year if all of the following conditions exist:
(1) The peace officer's motor vehicle is exhibiting at least one
lighted red lamp visible from the front and the person either sees or
reasonably should have seen the lamp.
(2) The peace officer's motor vehicle is sounding a siren as may
be reasonably necessary.
(3) The peace officer's motor vehicle is distinctively marked.
(4) The peace officer's motor vehicle is operated by a peace
officer, as defined in Chapter 4.5 (commencing with Section 830) of
Title 3 of Part 2 of the Penal Code, and that peace officer is
wearing a distinctive uniform.
(b) Any person who, while operating a motor vehicle and with the
intent to evade, willfully flees or otherwise attempts to elude a
pursuing peace officer's bicycle, is guilty of a misdemeanor
punishable by imprisonment in a county jail for not more than one
year if the following conditions exist:
(1) The peace officer's bicycle is distinctively marked.
(2) The peace officer's bicycle is operated by a peace officer, as
defined in paragraph (4) of subdivision (a), and that peace officer
is wearing a distinctive uniform.
(3) The peace officer gives a verbal command to stop.
(4) The peace officer sounds a horn that produces a sound of at
least 115 decibels.
(5) The peace officer gives a hand signal commanding the person to
stop.
(6) The person is aware or reasonably should have been aware of
the verbal command, horn, and hand signal, but refuses to comply with
the command to stop.

Looks to me like they can't pull you over unless they have a red light, siren, clearly marked car and are in uniform.

Makes sense to me. I'll forward this to someone and see if I can get a better answer, but I bet you could fight it in court if all these conditions arent present and win.

Unmarked units are used a lot for enforcement, although a traffic dedicated unit will be clearly marked. Unmarked traffic units will have all of the equipment, but there is no law precluding the use of unmarked cars for stops. The solid red forward facing and siren are the requirements for the emergency vehicle.

While running may or may not meet 2800.1 (a) CVC that again will be determined by the DA in that case. Just remember that all that is needed is a driver description and a license plate if you do decide to run.

i onno if this helps BUT what i heard from my friends dad who is a cop he said that you can drive to a place to pull over that you feel safe as stated before just signal cops you have intent and also once you have been pulled over you can ask for a marked vehicle to be present when recieving a ticket just tell the cop in a nice way i would like to see a marked car and they will call in and get a person in marked car sent to you just dont be a D bag about it !

Good advice, and I agree, follow all traffic laws and drive safely while finding a safe place to pull over. It depends on the Department, but unless there is a real exigent circumstance we usually have a marked unit do the traffic stop; especially if the unmarked unit is a plain clothes car!

Most of the time unmarked units are used as "spotters", and anything done infront of the "spotter" will get you the same citation as if it were witnessed by a marked car.

Personally I don't like the use of unmarked units for traffic for everyone's safety.
