I know this because my uncle is a liaison to the district attorney and had to tell them to drop a multimillion dollar drug bust because the initial stop was over a brake light being out BUT it was the third brake light.

Now in CA, if you have a third brake lamp equipped it has to be working, per 24252(a) CVC. Although, the law (CA law, as I do believe the center lamp is a federal standard*) does not require a third brake lamp anywhere in 24603 CVC (or its subsections covering stop lamps on vehicles). The catch all has always been 24252(a) CVC which covers lamps required on the vehicle must be working if the vehicle is equipped with them.
Basically if you don't have a third brake lamp, then cool; if you do and it isn't working, enforcement stop on a violation of 24252(a) CVC. The only laws in 24603 CVC about the supplemental (center brake lamp) are mounting requirements and re-iteration that they meet Federal standards. etc. etc.
EDIT:* Center High Mounted Stop Lamps (CHMSL) have been standard equipment on all new passenger cars sold in the United States since model year 1986 and all new light trucks since model year 1994, as required by Federal Motor Vehicle Safety Standard 108.

1) 1987+ all (supposedly) came with third brake lights...
2) Law says any light on the car (that it came with) must be functioning (which is still different than what warrants a legal stop)...
3) A cop is not going to see no light at all and pull you over for removing it... Let's be honest, how the heck would he really know 100% for sure your car is missing something like that?
My replies are of course based on CA vehicle code, whereas other states may have statutory requirements for the third brake light unlike CA's reliance on manufacturers being in compliance with Federal law; such as the example given by "dragcamaro" above for West Virginia.
It is always best to consider aftermarket parts as off-road only use but under the specifics of CA law one would have a defense for a citation; and it would be based on the judge's interpretation of the Federal requirement versus the state statute.

The car is getting resprayed SOM but I am having all the orange peel removed and the paint gets buried in a high quality/high gloss clearcoat. I am hoping to keep this car as clean looking as possible, and the Strano Springs and Gunmetal w/polished lip C6 Z06 Deep Dish Wheels (18x8.5/18x10.5) should really set this car off. Thanks again to 6LE who makes parts that we can all be happy with. I will keep updates and pics coming.
