<strong>Unless you know this guy Steve I'd have a problem of him using a picture of your car, the seller seems to have maybe a little above average negative remarks about him. Just my .02 cents worth.

Maybe Steve has given his permission to use the photo but if not I would contact this person and tell him to stop using the photo.

Your question is a good one, but I feel similar to using a photo of your face without a waiver is a no-no, I feel using a picture of your property without permision is a no-no, would it stand up in court?? Doubt it.
Im sure its a "public domain" thing and that since i posted it in public I have no "expected right to privacy".. Now if he was saying my car had this mod.. or missrepresenting it somehow I could probley do something.. but he just shows a pic of it..
Its a compliment but also troublesome.. I should check his other auctions to see if its there too.. At least he is selling a valid mod at a reasonable price.. not a TB Bypass for $30 or a Tornado air kit.. lol

It is legal to download pictures and data for personal use. If he wanted to use your car as desktop wallpaper, he is well within his rights. However, just as you cannot put a person on TV who has not signed a release, or post a picture that did not originate from you in a newspaper, he is breaking copyright laws by posting your picture in his ads for commercial purposes. You now have a case against both the seller, and eBay. I would pursue eBay, and they will in turn pursue the seller. Just as an ISP cannot hold images of child pornography, a hosting service is responsible for its content.
