What base OS are you using in the E38? I have an '07 Escalade VVT OS (which used a TCM) and with the T56 VSS wired to 71/72, I never had the scanner reading 158mph, it always read 0mph even without the HPT mod. I guess I can test with it disconnected, but having trouble finding time to do any car work right now.

I followed up in my build thread at the end of page 4 and through to page 5.

I suspect that the 158mph issue is something in the newer OSs that the HPT modification isn't accounting for. The mod and suggested connection worked for my 2007 OS. I'm not sure if running the 2010 OS is something you need for your swap, or if you can get a 2007 VVT E38 OS programmed?
