Actually we don't assign fault to anyone. We just write the report based on witness statements and file it with the insurance companines upon request. Based on the facts presented "they" assign fault.

Your car moving foward and hitting someone in the rear "regardless of the circumstances" is careless driving. Always maintain a safe distance even while stopped. How you can blame the clutch is beyone me...... lots of people have "racing clutches" and don't go around hitting people in the rear. Sounds like your car is poorly maintained from a driveability standpoint and you knowing you had a problem with the idle and the car dying choose not to get it fixed... caused you to hit someone in the rear. Unless the clutch was driving?

Actually, it depends on the officer. I just got a ticket last week in St. Clair Shores, and my wife couldn't find the registration or insurance card while we were pulled over. If I bring the registration and insurance proof with me to the courthouse and they waive the fines.

But it could've been worse. Could've damaged the radiator. I'd take a look at the car, it's having problems with the AC on. Might need to tune it.
