Default SERVICE RELATED WARRANTY

O.K....heres the worst scenario, so you can get an idea what to expect. This happened to me about 6 months ago and the outcome.
I have a 99 TA, been service by the same dealership without any problems, until a new rep. came in. I brought it in with what I thought were synchronizer problems in the shifter, dropped it off, and got a call later from my service rep. saying the new service manager had denied my claim because he saw I had a NOS sticker on my back window. They hadn't cracked a nut on it, didn't even touch it except for some interior work replacing a dash that had cracked due to sun wear and tear I guess. I tried to get in touch with this guy for 2 weeks, even made surprise visits, but he was always somewhere else. The Moss-Fergusson Warranty Act of 1975 specifically states that dealerships cannot void your warranty due to aftermarket products on your car. The only way they can is once they have checked the car out, they must prove that the warranty issue has been caused directly by your replacement part, and it must be given to you in detail in writing. Just because you have an aftermarket product cannot relieve the dealer from performing maintanence on your vehicle unless this is done. Its the law, passed by the U.S. Congress in 1975. Not the implied little deals in the handbook that comes with your vehicle can override the warranty act. They must prove that your headers caused the failure of whatever your problem is. And you have the right for every future problem to have it serviced. If you want exact terms I can look them up for you. My custom shop here provided me with the info.

That actually sounds like the norm, but the question is... what have you done or what are you going to do and what are the results...... inquiring minds want to know... good luck, we are rarely the winners in these situations. <img src="graemlins/gr_guns.gif" border="0" alt="[guns]" /> dealerships.

Sorry...I meant to put the outcome. The last solution after going down the line was to contact the Better Business Bureau and file a complaint, which I did. Well, GM didn't want problems so we went into arbritration, and after they selected a nonpartial judge-like person, I showed up to find nobody from GM there, but a teleconfernece with a rep. Anyway, they keep saying that in their little book it clearly states that there can be no racing, which I denied of course; showed how the first NOS was used in World War II on our fighter planes for acceleration used for getting away or catching another plane. No engines ever blew up on them nor where there any major hazards. Showed how they never even looked at it or gave me anything in writing; had the 'lady judge' look over the manuscript that I brought with the Warranty Act in it, did everything I was supposed to do. The GM guy didn't have 'poop'. Just kept with his 'racing' thing, which had nothing to do with the repairs, etc. They have to look first before they can deny.
Well, 12 days later after the 'lady' wanted more information, she denied!!!!! my complaint! I had it all in black and white, but she must have been nearsighted! Ha! I already had had the problem fixed, and my warranty had just run out, so I could drop over onto my extended warranty and try if I wanted to, but...'fawk them'!
Who won? I guess they did because I didn't want to pursue it any further, but if I had wanted to retain a lawyer, etc., I am told by two lawyer friends that they would have backed off and the 'case' could have been presented where the lady had no doubts.
Whats the final verdict here? There is a law protecting warranty issues, I guess you just have to want to go all the way if its that important to you. I went about as far as I thought it would take, but forgot that everybody is human, and I trusted in a person who knew very little about such things. Another lesson learned.
My old Service Manager is back now anyway, and he still takes good care of me. Hope the other got fired up the butt!
