I drive my car pretty hard and ive never had this problem. Not with the stock oil pump, or my ported LS6 pump. and 40psi is not enough oil pressure for WOT runs. But i agree with SuperSlow02 change the oil and see if it stops. might as well try the cheap fixes first.

the first time i noticed it happening..had me worred but it only does it to me around 2-3k. And after the oil is changed, goes away. Either that or engine is burnin up oil, but not enought to set of the low oil light.

I have had my car do the same even right after oil changes. It only happens between 2000 -3200 RPM. And I always have at least 60 PSI by 6000RPM.
