I informed the lady that I offered to return the part on my dime. She said that changes things and re-opened the dispute. I was told to send the documentation showing that I tried to return the part.

The unfortunate part is that I can't talk to the dispute team, only fax them the info I have. I asked the rep to notify them and have them call me.

So as of now, the case has been re-opened and could take another 6-8 weeks to resolve.

The internet crime complaint center is still looking into it as well.
Update:

American Express gave me a full refund. I was able to actually speak to someone the second time around and explained in full detail (with documentation) what happened. Sometimes it takes talking to someone to get them to fully understand the issue.

For the record: I was telling the entire truth! The stall never came out of the box except for pics I took to post up here. Sucks it took this long to get my money back, and boy did I learn a BIG lesson. Thanks to everyone that stood up for me even though I was just a guy on the other end of a keyboard that made a HUGE mistake when purchasing a used part.

Dru,

I had every intention in pursuing this legally. I was fully aware that it would cost me more than it was worth $$$ wise to resolve this. It wasn't about the money anymore and more about the principal. People like you deserve to get what's coming to them. I searched Xplicitperformance (you) enough to know that you knew that wasn't a yank stall you sold me. And for that, you deserve to be prosecuted. This isn't over for you or me. There have been several agencies that I have been in contact with that take this kind of issue very seriously. You'll either be getting a knock on the door, a letter in the mail, or both at some point. Good luck with that, and I hope I get to meet you in court.

Anyone want a free stall?? If your local to me, come get it, or I can meet you somewhere. If your not local to me, all I ask is that you pay shipping. Shoot me a PM with your zip and I'll get back to you ASAP on the shipping cost.

I have no info on this stall so please know that this might, or might not work for you. If no one wants it, it's going in the trash.

Wow, I'm excited to see you got your money back. I must say that throughout this whole ordeal, you have been very professional and handled this in the exact way it should have been handled. Please let us know if you get to give him any more of what he deserves.....

To the sponsor that wants Andrew's info. Your preferences do not allow me to PM you. Either allow PM's or shoot me another PM with a phone# so I can call you.

Thanks,

Wow I am glad to see that you won this dispute! The other guy is a real doushbag for not doing the right thing If you have your money back continue to put out the word on this guy; however, may I caution you as an older guy myself don't waist your precious time here on earth messing with that losser in court unless you have to. You will find later in your life you will be glad you didn't loss anymore of your time on him than you have to. Spend it working on your vette or hopefully with your family JMHO

I have read this whole thing, and dont flame me, but I kinda see where explicit is comming from. Imagine if you sent someone a turbo and after 2 months they want to return it because it may or may not be what the seller and buyer thought it was.

He didn't paint some random stall red and pass it off as a yank, he was told what it was and relayed the info rather than do research(which was a screwup on his part) I personally think you should give him the chance to pay shipping/processing(your time and labor) to ship it back to him.

Then again this didn't happen to me so what room do I have to say anything.

^^^ Dude he offered to ship it back to xplicit performance on his dime just to get his refund. Xplicit tried to pass it off as a restalled YANK, but Yank stated thats not even their converter.

I would never do what xplicit did because I am in the same boat. I have a converter that I just found out was a fuddle stall in the car I bought. I did research on it and found it to be not so good of a converter. Don't get me wrong I have gone 10's on it but I will not sell it to anybody, so it is going in the garbage unless somebody wants it.

Yea, ya got a point, I would just totally be on the buyer side if it hadn't sat for 2 months. I mean as the seller of the converter I wouldn't know if the buyer had installed it incorrectly with like no fluid or did something wrong, then blew the bitch up on the street or track and then trying to send it back. I agree it is not a yank though.
