technically even tho he is under 21, he can still carry a handgun in his car.. under the 3 step law, and it has to be "gifted" too him.

Sounds like to me you need to be more responsible where you hang out. If you knew someone didn't like you there you should have left right away and not talked to anyone about whatever you tried to talk about. My advice to you is that you need to be smarter.

Me personally, I would have not called the police I would have caught the guy by himself and took care of him win or lose. Kid, you need to get some heart

First of all look up hewitt texas its one of the safest communities as far as crime goes.. second it was a girl that had a problem with me and I'v had past issues with her but they have all been straightened out by talking.... my buddies that live over the house where ASLEEP I did not know this at the time and like I said I didn't even know this guy..

oh ya I would have gladly not called the cops if he didn't damaged my car I just bought for $9k 3 weeks ago.. beating him up is just that beating him up its not going to fix my car..

Like someone said earlier, U can have a shotgun. ( I did when I was 18 )

I am in the process of getting my CHL (its a long one right now) Im 22 and love carrying my .45 around.

But in this event u were going to a buddies house, got a call from ur chick that some other chick said u where there and u never got out of your car? How ******* long where u there b4 all this happend? I wonder how the attacker would describe the story?

Anyways even if I was carrying my gun or guns on me (sometimes the .22 is cool to carry) I would of probobly took off too. If someone is that close to u. U want to make space then kill him... Cough cough I mean STOP him. Since thats what ur supposed to do when u pull a gun...... STOP someone from doing what they are doing or trying to do. You never want to give them a chance to take ur gun.... so in this case u did the smartest thing possible after you got yourself in this situation

(I mean even if you didnt start **** U have to blame yourself for your problems. I mean no one else cares enough so it doesnt matter. And you could of avoided this by simply leaving as soon the the ******* started talking ****. But at that time you might not of know what was going to take place, either way could of been worse, could of been better)

Oh, and good luck with the F-Body, urface will heal. F-bodys dont do that yet......

very good idea.....and the best part is there's very little downside to using it on someone, since it's not a lethal weapon.

Generally, the essential elements of assault consist of an act intended to cause an apprehension of harmful or offensive contact that causes apprehension of such contact in the victim.

The act required for an assault must be overt. Although words alone are insufficient, they might create an assault when coupled with some action that indicates the ability to carry out the threat. A mere threat to harm is not an assault; however, a threat combined with a raised fist might be sufficient if it causes a reasonable apprehension of harm in the victim.

Intent is an essential element of assault. In tort law, it can be specific intent—if the assailant intends to cause the apprehension of harmful or offensive contact in the victim—or general intent—if he or she intends to do the act that causes such apprehension. In addition, the intent element is satisfied if it is substantially certain, to a reasonable person, that the act will cause the result. A defendant who holds a gun to a victim's head possesses the requisite intent, since it is substantially certain that this act will produce an apprehension in the victim. In all cases, intent to kill or harm is irrelevant.

In criminal law, the attempted battery type of assault requires a Specific Intent to commit battery. An intent to frighten will not suffice for this form of assault.

There can be no assault if the act does not produce a true apprehension of harm in the victim. There must be a reasonable fear of injury. The usual test applied is whether the act would induce such apprehension in the mind of a reasonable person. The status of the victim is taken into account. A threat made to a child might be sufficient to constitute an assault, while an identical threat made to an adult might not.

Virtually all jurisdictions agree that the victim must be aware of the danger. This element is not required, however, for the attempted battery type of assault. A defendant who throws a rock at a sleeping victim can only be guilty of the attempted battery assault, since the victim would not be aware of the possible harm.

Aggravated AssaultAn aggravated assault, punishable in all states as a felony, is committed when a defendant intends to do more than merely frighten the victim. Common types of aggravated assaults are those accompanied by an intent to kill, rob, or rape. An assault with a dangerous weapon is aggravated if there is an intent to cause serious harm. Pointing an unloaded gun at a victim to frighten the individual is not considered an aggravated assault.

Well I was going to my friends house to visit him since he just got out of basic so I stopped by another friends house to see if he was up. Well this girl that apparently has a problem with me was in the garage or something. So I get to my buddies place and my girlfriend calls me telling me she got a text message from that girl saying why was I over there. So naturally I call the girl and she says all this stuff I supposedly said anyways I said lets talk about it and she said ok (this isn't even her house remember).

Anyways I get there and 2 guys come out to my car that usually aren't over there one asks why i'm there I said im here to talk to so and so and to straighten stuff out he says you can talk to me, I told him I'm not fighting you dude... he said get out of the car and grabs my door handle (locked) I told him again nope.....he then hit me in the left side of the face and try's to grab my head or something like that... as this is going on im starting to dump my clutch with the e-brake on and he punches my quarter panel (slight wave minor scratches)

As soon as I was down the street I Called 911 immediately and me and my buddy went up to the station and filed a report the police got pictures of my face (barely noticeable, and my cars quarter panel)... the cop I talked to knew where the assaulter lived previously so I imagine he has a record

I wasn't about to get out of my car without knowing what weapons or how many more people there where damn I wish I was 21 with a gun about now
I've gone through and taken many hand gun courses and have my concealed weapons permit...let me tell ya, it would have been your first and last mistake if you had pulled a gun. Because you were in a car and able to get away, that would have gone against you without a doubt. The first thing they tell you in the safety class is, "If you pull out a gun, you better be shooting to kill." I know that seems harsh but the last thing they want is gun owners thinking they have the right to start flashing their gun at everybody that looks at them wrong now that they have a permit..though it may have given Billy Bad *** that punched you a quick wake up call how and how big of a skirt he really is

Jesus there are a lot of retards in this thread. "I'da killed that ther sumbitch!". The very thought of some people carrying guns scares the **** out of me.

Pepper spray or taser. No reason to go killing people because they want to fight you.
