it never hit you that losing future business, lawyer fees, court costs, etc. may not be worth the 400 bucks? its not like youre losing 400 bucks, youre simply giving it back and itll be just like before. he even gave you an out and offered to pay shipping lol. not to mention, you wouldnt be able to countersue. so what do you seek to achieve here??

Honestly, I doubt you are going to get anything from XP. I'm pretty sure this thread will come up when anyone searches on his screenname to check out past deals. His reputation is screwed. Any legit seller would have refunded the money back even if they were unaware the product sold wasn't as advertised. Especially considering it was only valued at $400 and there was legitimate reason you didn't find out until two months after the transaction took place. The talk about law enforcement and attorneys on his part is pure internet ninja BS. If the guy can't afford to repay you $400 to maintain his reputation, he surely can't afford an attorney. I crack up when someone in the wrong starts throwing out statements like that.

XP might as well go out of whatever business they are in cause from all the sites I've seen this on nobody's gonna do business with him or anybody in Alvin, Texas wherever the hell that is. Woulda been simple to refund his money for that POS non-yank 70's Vega converter and tell him to throw it in the trash since he wouldn't want it back anyways since he knew it had no value other that the shipping charges from it's weight.

Do a google search on Xplicitperformance. The negative trader feedback thread is the forth link. A few more posts and it might rank higher than his own site.

well for one of course your attorney is going to ok it they kinda want your money, and as far as local authorities go? They don't have much say in your case seeing as they have no jurisdiction in it. Simple fact is you falsely advertised something sold it and refuse to give a refund, yeah that should hold up reallll well. Man up and just give him the money back and stop making a big deal about it.

With all the evidence you've posted it will be easy to settle the case in your favor, especially with the correlating info you've received from Yank. I personally don't think you need an attorney, just with evidence and all the info. The original thread, the pictures, Yank info, his statements and the statements of others saying that it isn't in-fact a yank. It will be cake to get your money back.


The only possible argument he can throw at you is the fact that you waited 2 months before you decided to put it in. But its very unlikely to hold up in court.

I'm not concerned with his threats. To be honest, I've never been to Texas. My wife and I could make a vacation out of the trip. I just hope he understands that if he summons me to court and loses, he'll have to pay for all my expenses to get there, pay me for the day I had to take off work to come down, ect.

He has no grounds at all to take me to court, but it's still nice to think I could come checkout Texas.

This thread is hilarious. I've been 5-6 fbody forums for the past 5-6 yrs and I gotta say. If I was XP, I would have realized I was wrong and forked up the $. Instead he's being stubborn about it. And is name is now ruined. I know he can just get a new member name if he wants, but I think he cares about his name a little more than he's acting.
