Default "reckless driving"

well I figured Id go ahead and post uP my story that happened about 3 weeks ago or so. Basically I spent a night in jail for bullshit.

Well I was goin towards a friend house i was on a residential street. I was goin the speed limit which was 30 and I had it in second so yeh it was kinda loud with long tubes and true duals. I went to his house and he wasnt home so i came back I was turnin off from another street...I ran the stop sign but was goin slow so I just yielded it and plus no one ever stops there.....so yeh I turned and seen a guy joggin in the middle of the road wavin his hands and I seen a dog right there so I figured it was his..tellin me to look out for it. So I stopped he came up to my window and he goes..turn off your car im an off duty state trooper, so I turned it off cause I didnt do anythign wrong. Then he was like...give me your keys and i wa slike why and he goes give em to me and i wa sjust like tell me why and took the keys from my hands and ran to the nearest house and told them to call the cops...2 city cops and 2 sherriffs came out there said I was reckless driving and it was a class b misdemeanor.....so they took me to jail..now im out of a $1000 cause this bullshit. $125 for bail, $160 to get my car out and 700 for a lawyer so I wont get charged for this. In one of the police repots I read he said he "feared for hIs life" becaUSE I was goin at a " high rate of speed" He told other officers that I almost hit him also when i never evEn came close.

Basically I was just wondering what you guys would do cause my parents wont let me drive my car (im 18) cause they think they'll pull me over for some bullshit and take me back to jail which i dont blame them cause they thought it was bullshit to. Is There a way I could get that thousand dollars back since all this was bullshit cause basically its my word against his and we all know who the judge is gonna believe since im an 18 yr old with a sports car


o yeh forgot to add one more thing...last year in may i went to jail for evading arrest but I was passenger so i dont think thats gonna go to well with them but then again I havent gone to court for that either...

if he came up to my car i would of been like b.s. and drove off i dont care if i knew he was actually one or not...off duty imo means off duty

In the state of texas a cop cannot stop your can unless A)hes in his car and hits the strobes, or B)is in uniform and flags you down. But with the way things are going now, the courts are gona always find a way to stick behind theyre own.

i've noticed alot of tools coming around this time of year, and that was a complete assinine remark. If you had the same incident happen to you, i bet you wouldn't want people to be critiquing your grammar, or any of that. This was a post, not a college essay.

Dude that is bullshit, I can't believe that ****, CAN WE ALL SAY ABOVE THE LAW, **** I would be going after that guys badge, and then sueing the city for **** like that. He was off duty and fear for his life and you pulled over to talk to him, how is that fear, and he took your keys, I would have beat his ***, then he could say he was in fear after I made him a pile of rubble, if he didn't have ID and took my keys, how and I to know he is a cop, anyone can Identify themselfs as a cop, but who really knows now days.

Don't know what else to tell you, but I have seen cops get away with all kinds of ****.

i would have never even slowed down, and if i did, i woulda told him to go **** himself if he asked me for the keys! have you ever hauled *** thru that neighborhood before? do you drive thru it alot? did the officer drive a mustang? this sounds like total BS! just remember that "Driving reckless" is a relative term, as is "too loud" (well untill its over the legal DB limit). hope it works out for ya.

Yeah, but you can get nailed HARD now for kickin a cop's ***, even when off duty, when they start the fight, when they dont mention they are a cop. (Friend is getting nailed hard with this right now)
I do think the situation is bullshit, and I believe that if a cop is off duty he is off duty, just another regular guy.
What does your legal advice say? if you can say.

well I say you take the evading arrest to court and plead not guilty if you were just a passenger uness you jumped in the car after he tried to stop you but if you were in the car and the driver just kept going, there's nothing you could do about it.

the more recent thing, not much you can do about it except get it expunged, that can come back and kick you in the ***

well the Lawyer said that they may charge me with "deadly conduct with a motor vehicle" but hes not really sure. I drive down that streeT almost every day and supposedly they have complaints about me all the time about haulin *** down it, I think its cause my exhaust is so loud i dUnno? I think about 90% of people that drive down this street are always speeding.

Then one cop automatically thoUght I was rich because I drive a sports car and I didnt have a job at the time he kept harrassin me about that.

I dont know hopefully They can drop this bullshit and I at least get my grands worth back?

first off, if the ****** isn't in uniform i'm not stopping. and second, if a guy walks up to my car and starts yellin at me, damn right he should fear for his life. sounds like he was riding the high horse and someone needs to pull him down off that and kick him straight in the nuts. cops are goin on power trips too often these days, there aren't enough guys like K9Kev around anymore. sure K9 gives out mucho tickets....when you're doin 79 in a 60.....

i'd countersue on the grounds of abuse of authority, as well as slander since you said he was talkin **** about you while he was writing you up. if the law holds up that an officer of the state cannot use his authority to pull you over unless in uniform, then this whole deal gets dropped.

PLUS, HOW THE **** WOULD YOU HAVE HEARD HIM IF YOU WERE AT A HIGH RATE OF SPEED W/YOUR LOUD *** EXHAUST? you wouldn't have heard a bullhorn. start looking at how to defeat this moron at his own game, b/c there ARE such thing as Appellate courts that convene outside of his 'boys club' that meets every thursday nite.

I would check to see if the guy was really a Trooper. If he isn`t he was inpersonating a cop. He can be jailed for that. I had that happen with my friend one time, but this guy walked up and started chocking my friend. The only reason he stoped was because he thought it was someone that I knew. For some odd reason the dude saw somthing he didn`t like and walked back to his garage.
