I never knew being drunk in a bar was illegal, but apparently it is.

I saw that in the news about a week ago. Irving is doing it too, they also took the bartender in for over doing it with the drinks.

Im making sure I dont go to a bar in Irving. I could just imagine hanging out with friends having a good time and that makes it seem like your drunk and whats happens they take you in and you get a citation. **** THAT!!!!

Jail sucks. Atleast Texas is not as bad as some other states out there.
We still have death penalty here.

Ron White that is greatness. I heard them talking about this on the TICKET today, how desperate is the govt. getting to completely being out of control. I understand trying to curb drunk driving but this is a low ball tactic. Once again another reason to vote for Kinky he drinks and rides in parades at the same time.

They arrested people staying at a hotel drinking at the hotel bar. WTF!!! Way to take care of the DWI problem.

If you don't act like a drunken idiot in a bar, then you have no reason to worry about getting arrested. It is not like they're walking around with a breatalizer asking people to blow into it and arresting them if they blow over a 0.08% BAC.

They are simply asking you to come out side unknowing to there offiliation, and then BAMMM your hit with P.I. I just think it is another way the system is not working properly.

Bar patrons may be approached if an officer spots them behaving erratically, such as having difficulty walking or standing. The officer will perform a field sobriety test similar to one for drunken drivers. A patron may also be asked to take a breath test, although it is not required, Beck said.
To me it just sounds like a way to remove those people who have never had a drop of alcohol before but think they can handle 12 drinks in 2 hours and are puking or being a nuisance. We've all seen those people before and they are a nuisance. I don't think it's worth getting overly concerned about; I know I am won't be. I'll be at a bar somewhere this weekend drunk and won't be looking over my shoulder for cops.

They are doing it here too. A friend of mine was walking to the cab that he had called when the cop assested him for a PI $250 to bail out of jail plus a court apperance and a fine.... what bullshit

Dallas morning news ran a story about a guy staying at a hotel in Dallas, who was down in the lobby bar of that hotel(where he was staying!) having a few drinks. TABC came in and arrested him for PI, and the guy lost his job.

Granted, they have to articulate on the PC affidavit that you were a danger to yourself or others. So you could get arrested, but you might have a chance in fighting and beating the charge in court depending on your specific situation.

Still BS IMO, and the TABC is really creating some negative press for themselves. If they are really concerned about DUI, then they should setup checkpoints.

The guy at the bar had a hamburger and six beers, now you tell me how drunk. I am under the impression it was not this man's first time to drink a beer. There is no explination for this kind of crackdown, they are simply trying to reinvent the wheel here. So this weekend whether your out at the track,at a bar,or out for a nice dinner with the better half you need to be careful cause you will be in jail. Reminds me of stories from **** Germany !!!

Sounds like a money making scheme to me, you know once you pay that fine, TABC gets that money. TABC is not out there for the safety of other people they have their own agenda. I go to other states and say we have Alcohol Beverage Commission and they say what is that, hmm I wonder why everyone in Texas has heard of it?

State of Texas definition of Public Intoxication


PC 49.02 Public Intoxication

a) A person commits an offense if the person appears in a public place while intoxicated to the degree that the person may endanger the person or another.

(b) It is a defense to prosecution under this section that the alcohol or other substance was administered for therapeutic purposes and as a part of the person's professional medical treatment by a licensed physician.

(c) Except as provided by Subsection (e), an offense under this section is a Class C misdemeanor.

(d) An offense under this section is not a lesser included offense under Section 49.04.

(e) An offense under this section committed by a person younger than 21 years of age is punishable in the same manner as if the minor committed an offense to which Section 106.071, Alcoholic Beverage Code, applies.

any law based of an officers judgement needs to go away. they have breathlyzers for a reason, set a number for PI and tell us what it is.
