Default Legal help

i posted this in the texas section because i want help with local/state law. i would have done SSU, but i dont need someone from NY or CA helping me. does that make sense?

my sister in law had her identity stolen. what's happening is that some girl has her name and house adress and opened up a bank account and she is printing checks on-line and going to stores and buying lots of ****.

the stores wont help her. the bank where this unkown girl opened up the account told my sis in law they cant release any information to her. the cops havent done much.

and she is getting most things cleared up with the stores, they know its not her, but when she does that, the girl just opens up new checks and goes buy **** again.

did this make any sense?

my question is, what can/should she do?

has ne one gone thru this?

thanks for the help!

Unfortunately, the police are the only route to that.

Something seems wierd, you cant open a bank account without a photo ID... government ID... and a SSN. Either I am crazy or there is an insider in that bank.

Call the credit bereaus and let them know that her identity was stolen and if she has a credit card they sometimes have services that help with identity theft.

I recently opened a Wachovia account online using only my SSN. There's no Wachovia near here. I did talk to them on the phone, but I've never set foot in a Wachovia nor have I provided any real evidence I am who I am.

Sadly, it's terribly easy.

The PD should have given her an "Identity Theft Packet" with all the #'s that she will need. Get a copy of the police report, contact the credit reporting agency's (all 3) to put a flag on her credit report. Doe's the PD have all the information about the bank where these checks are being printed? The bank can't release information to her about her? The bank should have some type of form for their own investigators that she would fill out and the bank would investigate it also.

my mom had her identity stolen about 2 weeks ago. We were in the middle of a big scam where people were getting peoples debit card info and buying lots of heavy machinary equitment and was sending it to nigeria. My mom stayed on it for days. She called the bank over and over agian untill they put the money back in our account and we were contacted by the secret service and they kept an eye on my moms identity. Other than that i cant help. Hope this helps some!

yea the pd gave her info and the bank/ stores where she's being charged money are clearing her name, but then this other girl has the green light again. other than that the pd has not been very helpful.

i forgot to mention that my sis in law lost a purse it contained an id with an old adress, but the checks are being opened with her new adress. or at least the notices are being sent to the new adress. the kicker is that in her purse, there was no info on her new adress. weird huh?

if she does call the credit bereaus(SP?) will it help? they are not opening up credit cards, they are paying with checks.

They aren't doing Credit Cards yet...Just a precaution. I'd rather be safe then sorry. Just out of Curiosity, what PD is it?

Yeah you want to contact the credit reporting agencies I believe there are three and they will help keep things like bounced checks off of her credit if one makes it by without her catching it etc... The also are one of the first to know when a transaction it made also. Good luck it is a PITA.

Call the credit agencies (transunion, equifax and experian) and that bank sucks! Any bank that doesn't get proper ID isn't a good bank. She should go down to that bank with her info and tell them to verify it is her and if needed then she should fill out an affadavit of some sort. I hate people who take the time to do ID theft! If you need more numbers PM me.

Call the FTC. No joke. They have a section especially for this, and you have to have already been defreauded to initiate a dialogue with them.

Show up to your bank in person, speak with all of your creditors and the ones the fake girl has opened.

The sad part is there really is no formalized one route for these things, you basically have to handle them one at a time, put a fraud alert on your accounts and identity, and talk with everyone and let them know what is going on.

Call the big 3 credit bureaus and put a fraud alert on her ID. That should keep people from opening accounts in your sis's name without calling her first. At teh very least, it gives you an instant free copy of your credit report so you can see exaclty what is there and what should be there, and start weeding out the things that should not.
