Default Got a ticket... have a question

Hey guys,

Long story short i got a speeding ticket that was 53 in a residential area. I really dont feel like i was going that fast, granted i was speeding and shouldnt have been in the first place. Here is my question, I asked the officer if i could see his gun because i really didnt feel like i was going 53 and he said "no" rather rudely. Do I have the right to see what he clocked me at? can i see his radar gun. It sucks living in college station because our police department can get bored at times and pull over the kid in the nice car because there is no real crime to fight here. Any advice would be great, I really dont want to pay this one...

pretty sure its contestable cause i think you have to see a gun if you ask but i can't tell you exactly for sure....where exactly did you get the ticket?

In the pebble creek subdivision. I have like a three minute drive from my house to my girl's house and i was on a long street that slowly turns right. i saw the cop parked on the side of the road infront of me facing forward (i was behind him) and he was talking to some guy on a bike. Before i passed him he lit me up and then proceeded to pull me over and took an hour to write my ticket. I asked how he clocked me and if i could see his gun because i was coming up behind him and he just told me his radar was front and back.

Go talk to John T. Quinn about it. Tell him your situation and i'm sure he can point you in the right direction. Worst case hire him to take care of it for you. He's off carter creek.

hmm sounds like you can definitely fight it to me since it may be beyond the law of physics. do some research on the police cars up here to see if they can clock people behind them but i highly doubt that.

Most have the rear radar unit... It's not that uncommon

Doesn't have to show you, and I've even used the rear view mirror to radar people after they've passed with the handheld radar when we first got it.

Thanks for all the info guys. I understand i was in the wrong for speeding but i really dont think i was going 53. I'm going to check the calibration on it and see if the officers license on it was up to date and such. will69camaro you have a pm

ya i could see if u where really going 53 in a res thats dangerous but if not i do 35 all day long in them

you wont win in court. and police speedos are certified calibrated along with the radar. Just face the fact you were speeding and dont do it again

how good are attorneys at gettting stuff like this dismissed? the guy i called charges $100 bucks and thats all so i think it might be worth it if he can get me off or atleast get if off my insurance

pretty much screwed on speeding in the residential area man....jst pay it and take defensive driving

Yes defensive driving would be a great alternative but I've taken it recently and you have to wait like a year or something. I appreciate the advice, my main concern is not the fine of the ticket, im more worried about my insurance and points and stuff.

man, I hate it when people say just pay it.

just get a lawyer, itll get reduced and be 30 days probation instead of 90 of 120

If you do it without an attorney tell the JP or Munie Judge that the officer refused your request to view the radar, I had one thrown out in Houston Municipal Court because I asked the officer in front of the judge why he had refused me seeing the radar, he told me he did not have to in a snyde *** tone, and the judge got pissed and dismissed the ticket on the spot, like he should have. I was surprised though.

Do get a lawyer, and ask for a jury trial. I have been on a few traffic court juries, and if the officer has nothing more than his testimony, I let them go every time. It may not be right, but am firm believer in having concrete proof when prosecuting people, and an officer's testimony is as good as an opinion in my book. Until the legislature fixes it, the state will suffer, not the people.

I would call the court and ask if they do differed... if they do, then do that. Ive done it about 3 times now, and it has been between the cost of the ticket (~$180 if i remember right) and $250. It wont gon on your record as long as you dont get another ticket within the next 60-90 days depending on the court. But you arent going to get off, even if the speed limit was 35, you were still going 18 over.... and if his gun was off by 5 mph you were still doing 13 over, and they are still going to give you a ticket for that. Just my $.02

Look at post #18, 53-35=18 LOL. Churchill, you said residential area, is that 35, or 30? Most tickets are the same fine from 1-15 mph over. As long as you were not going 25 mph over I would not worry about probation. Dont take deferred! It is still bending over for them! Drag it out. Listen to Mr. Quinn, he is a good attorney, tell him everything, fact or not, even if you think it is stupid, communicating with your lawyer can only help you! My old man still does traffic tickets for friends and family, his score still touts no losses. I laugh my *** off every time he comes back to the office from one, you would be surprised how ignorant of the law the clowns who enforce them are.
