My only fear in talking to them is that in the event they refuse to bring the cat inside and then something happens to their cat (Im not the only neighbor complaining about this cat), I am now suspect #1.

talk to your neighbors .. if they don't take care of the sitution .. then sen them a bill for fixing the damage..
you can also call animal control, if you see it out loose, and want to be a pain ..
first choice should be talking to the neighbors .. them may be unaware that it is even occurring.

i understand your point with not wanting to stir up **** with the neighbors if you arent 100% sure its their cat. you may want to try a humane animal trap so you can ID the cat. i doubt they are expensive. then you can capture the cat and wait for the neighbors to put 'lost cat' signs up aroudn the neighborhood... then you can collect the reward!
