Having problems getting insurance to pay for my claim... need advice.

Personally I would find another insurance company after this. My insurance company goes way out of their way to make sure everything is perfect!

^^^ X2 This is exactly what you should do. Provide all the info that you mentioned here to USAA and let them take care of you (and the car!). They will pursue the other people and you can move on with your life.

Yup from what I have heard and a personal experience long time ago...you get no where if the driver is unlicensed. Even though the car is covered. This guy that works with me now used to work for USAA and he said they suck!!! Says they will do whatever to not pick up the tab. I hope it all works out in the end for you.

had USAA for awhile now and have never had a problem esp. when it comes to others insurance. Wifes accident took less then a week to have a check to cover everything including the deductible plus a little pocket $$$

Exactly. Even if their insurance doesnt cover it you or USAA can take them to small claims court to collect on them.

Trust me if you call USAA and actually talk to someone other then the basic level person you will get some **** done. They will take care of you.

I called them. They called their insurance and they said that their are "coverage issues" and that they could not get ahold of the lady/her kid to talk about it. They sent a "reservation?". USAA pretty much said that they prob wont cover it since he wasnt insured etc. So I asked what my options were with USAA and they said collision. I then had to try to explain to her why it should be uninsured. She said I was wrong. I asked to talk to her boss. And she came back and said that they could do uninsured. So I guess I'm doing uninsured with USAA $250 deductible. Its gay since the damage isnt even that bad, but what can you do.

Do NOT do collision. Regardless of who is at fault YOUR rates WILL go up. Collision is used for at fault accidents. If anything it needs to be filed comprehensive because you werent in your car and it was parked.

I like USAA a lot but too many of their entry level workers just dont know too much to start giving out advice. You have a special case and you have got to talk to a manager to explain it to them.

I know it sounds like im being an *** but trust me on this issue. Ive had ALMOST the exact same thing happen.

I've been through this before. I was hit by an unlicensed driver who was drunk, had no insurance, and wasn't the registered owner of the car. I had to have my car fixed using my uninsured motorist coverage.Then my insurance company sued the registered owner of the car that hit me to recover the moeny, which in this case was the brother of the driver. It sucked, but at least I got my car fixed.

If they can't get ahold of the person they represent they CAN NOT contest what you say and you win. Call them and let them know that unless they can contest it or show why you are wrong it's not your problem. You will win if you take that route, them not talking to the people they are covering is always to your advantage.

Fix it yourself save all reciepts, contact them about repairs, if they don't want to pay then sue them in small claims

Both insurances are telling me that if they cannot get ahold of the person, then they can not award me the claim...

So I asked... "That means that I can go around, running into cars. And when it comes down to my insurance paying, I can just ignore the phone calls. And thats it??". They said "yup, but they might drop you for not doing your part of the contract". If anything IMO, the insurance wouldnt drop them bc they just saved them from having to pay. Its complete **** IMO.

Normally. I would agree with this if it was my fault. But since it isnt. its hard to come up with 750-1000 for something that I didnt even do. Worse comes to worse, I'll try to do the uninsured motorists. That shouldnt hurt my inurance rates?

Tell them you are contacting a lawyer, then really contact a lawyer. When you win they will have to pay lawyer fees too. They all hope that you will give up and forget about them and pay it yourself, and they don't mind making you mad or using shady practices to keep money in their pockets.

How old is the kid who hit your car? Does he atleast have a learners permit?

I'm pretty sure their insurance is BSing you and you were right.

Who is your insurance company? (sorry I just read that its USAA)

Are they a direct comapny? This is the kind of **** your agent should be helping you take care of even if you're not filing a claim he should give you advice if not call the other company himself. But a lot of companies don't have agents anymore and this is what happens.

If your insurance company / agent is of no help then call a lawyer like SD said above.
