Having problems getting insurance to pay for my claim... need advice.

Default Having problems getting insurance to pay for my claim... need advice.

Well as some of you know. My car was hit a couple weeks ago but an unlicensed driver. His mom was insured on the car though. I am trying to get their insurance to pay for it. But I guess she's not answering their phone and their insurance is telling me that they probably wont cover it bc they driver didnt have a license/wasnt insured on the car. But from what I've read on here etc, I thought the insurance stayed with the car, no matter the driver?

Either way. I called my insurance, not to make a claim, but just to get some advice. They said that I would need to put it under collision? If I end up going through my insurance, I want to do uninsured motorists, but they didnt give me that option? I think its bc the other insurance made a decision yet? What should I do? My car got hit on June 1 and this is taking entirely too long.

That is bullshit. The insurance covers whoever drives it, at least it should. A good friend of mine borrowed the Cobra the other morning because his car was broken (opti took a ****) and he got pulled over in it and just told the officer it was his friends car and he was borrowing it and the cop said ok.

Yup, Sarge is correct. It sucks in life when people do this. Also is there a new Texas Law about insurance, coverage and un licsensed drivers. I heard about it on a radio talk show. You may want to google that.

Where you driving or was the car parked at the time?

Whoever is driving the car that who is insured. It happened to me about 3 years ago. Mom was driving her car that I was main driver on and she rear ended another car. Even though I wasnt even in the states at the time (first deployment) I ended up being the one at fault. Her insurance rates didnt go up, mine did.

Also if you even have a half good insurance company THEY will go after the ones at fault.

My car was parked. And he backed into it. I have USAA so I'm hoping they'll end up being able to do something about it. Over all its just taking too damn long though Its been exactly 3 weeks. Its been 2 weeks since they came to get the estimate.

Call USAA and inform them what is going on. If anything youll file the claim under comp because the car wasnt moving. They cant make you file under collision because you werent driving the car and it wasnt your fault.

Did the other guy get a ticket for the wreck?

File a claim with your insurance company.
They'll get you money, and then go after the ones that are at fault however they need to.

No, once I began to call the cops. He drove over the curb and sped off. The cop was able to find out where he lived and went by his house, but gave him no tickets. I'll try to find my old thread with more info...

Their insurance said I can file uninsured motorists with my insurance until they accept or deny the claim.

So not only was it technically a hit and run, his insurance is trying to scam you into filing with yours. Unisured would be a fraud file for you seeing how his car had insurance on it.

Did you get an accident report at least?

Trust me call USAA and talk to a smart person. They are really great and will get you handled.

The police officer said he couldnt make a police report bc it was on private property.

I talked to USAA a few days ago, and they just kind of said to wait it out and see what their insurance comes up with. The police officer also said that it wasnt a hit and run bc the kid came and told me about it. ****, from what I heard, he tried to drive off, but a few people stopped him and made him come tell me.

In the state of TX if you leave the scene of an accident without leaving info its a hit and run unless they have changed that law.

That is what the insurance company wants you to do. Wait it out until you cant take it no more and then just give up. Put some pressure on them.

This is only the case with public property; the "parking lot" where Donohue got hit is private property. And he did say that he told him about the accident.

Ahhh didnt know it was private property. Yea that kind of screws things up. Thats why so many people dont leave crap after they have a fender bender in a parking lot. Personally Id wish they close that loop hole.

Yea he told him about it but he left and then came back. Was my understanding from my uncle that anytime you leave the scene its considered a hit and run. Not in this case though.

insurance will usually cover it if a licensed driver is in it, not unlicensed

well i can see you waiting for a while. i got rear ended and everything was legit. the lady contacted her insurance company and i called them. i did all the work, gave them an estimate, sent my title and pictures and continuously called them at least once a week. it still took them a month and a half.

This was the best pic I could get. The damage really isnt "that bad", but its gay either way. Especially since the rest of the car is damn near perfect.
Didnt notice it until I saw this pic, but it looks like the fender doesnt meet up with the bumber good now.
