Default Beat a Speeding Ticket Today

Well just thought we'd post up here and share our joy, haha.

Last August the GF got a speeding ticket in the Trans, she was doing 65 in a 45. Missed the first court date, because the court system had her address wrong. We considered hiring an attorney because I felt it was a violation of her right to a speedy trial, but figured it would cost around a grand for that, and, this being her first ticket, she was likely to get a PBJ anyway.

Well this morning at 9:00, she's the first one on the docket. She gets called up and her cop dosen't show up, so the case got thrown out! As we're leaving the court building another cop is following us out, and another cop is going in, we hear the one cop say "Dan, they already called most of your cases." It was HER COP! So we really lucked out today.

Only bad part was since she'd missed the first court date, although not of her fault, she had to prepay the ticket to get another court date. So it'll take 6-8 weeks we'll get the $150 back.

This is what I was told to do to delay my court date, by the court. I wonder if that **** works. The bastards denied my request for continuance and told me I had to do this. Bail money, WTF and since when did they stop giving postponements. Hum...maybe I should skip it...petition them since I told them I "can't make it" send them the 145 fine "prepaid" and hope the judge doesn't show up. What a crock. Good that she beat it...maybe this is what I'll do now. What district court was it in?

Also, it's over a year later that they rescheduled it for? Hurm...now I definately need to ask a MD lawyer about how to work this. I don't mind posting the 145 up front, if I can beat the ticket and get it back later.

It was in Howard County. It was just about 9 months after she got the ticket. I dunno what would've happened if the cop was on time though, we just pretty much lucked out that he didn't show up on time.

In New York there changeing there rules for State Troopers. To cut down court overtime payed out to the troopers they don't go to court anymore. It's all handled by the DA that is running the court. So everything will be pleaded down buy the DA or if the DA is a hard *** the ticket won't get dropped down to a lesser charge. So I wouldn't be shocked if every state started doing this. Not sure about local town cops. I'm sure it's just a matter of time

Moral of the story is...they're money hungry and it's time to start either A) fighting back entirely or B) just slow down. Even when you think you're trying to be good and you have just a momentary lapse in judgement (like I did on this last one), you still get nailed, yet the very very frequent and horific offendors (those that get multiple tickets a year or speed recliously) probably get repeated slaps on the wrist.

i dont know about new york, but here in south carolina, if the only witness (the cop) isnt there.... the state has no case.



but... ive had a ticket where the cop didnt show.... the judge just changed my courtdate... he wont drop it because the cop was out sick... he just rescheduled it.

i politely argued.
he took my ticket and wrote down the next court date.....



....incorrectly.
so i end up showing up for court after the date.. of course by not being there, im found guilty... and i got full points and fine.... bastards.

edit:
i later learn that the judge isnt suppost to write down the new date at all.. the clerk just outside the courtroom normally does that... (i now know better...... but the judge remains a bastard guy.)

In Oak Park, if the officer does not show you have to reschedule and keep rescheduling until he shows or pay the ticket. That’s a bunch of bull I witness a guy complaining that the officer has not shown 6 times straight and the judge told him to pay or reschedule……….WTF?

That's horseshit...how can they do that? He should def. get an attorney and have the att. tell the Judge that if the State can't produce it's witness in a timely manner, his 4th and 5th ammendment rights have been violated.
