Default shifting into 4th feels like second need help

alright guys here is my prob... while normal everyday driving the gears shift like butter... now when i get on it from 1st to 3rd its awesome once i go into 4th the car feels like it goes into 2nd but its in 4th and makes the car just start backfiring until i put the clutch back in.. the car only has 42,000 on it and about 3,000 on the new clutch, slave and master... iv also noticed that the fluid has a tint of black in it and its never been like that before??

any advice would be grateful

run hard, go 1, 2, 3, 5. If it does basically the same thing, troubleshoot fuel pressure.

Yea it definitely sounds like an engine load issue. I would start with simple things like fuel pressure and inspect your plug wires for burnt or damaged ones.

if fuel isn't meeting eng. load, you may backfire.
fuel required in 4th > fuel req. in 3rd > 2nd > 1st

incorrect timing could cause backfire too, but that's a lot less common an issue.

I would first determine if the bleed-off of the fuel pressure is normal and fix the problem "by the book" for now.
