is it bad to use 5th gear at the track?
when i ran that car last night i was running out of gear in 4th with the 4:10"s so i tried to go into 5th but all that it did was grind. .

It should go into gear whether you're racing or not. 5th gear sucks to use at the track because it's such a tedious gear to shift into. Does it grind when you're driving normal?

Hmmm, I would think shifting into 5th shouldn't really be a problem except that it is an extra shift and will result in a slower ET. Are you set at the stock rev limiter (6000)? If so, maybe the best fix would be to bump up the rev limiter to like 6200. Someone correct me if I'm wrong, but I don't think the stock valvetrain would have any trouble with 6200.
I believe 4.10s on a stock tire will take you to about 112 at 6000RPM. If you bump that up even 200, it will get you to like 115, and I'd be shocked if a bolt-on LS1 was trapping more than that.
Play around with this calculator and it might give you some ideas.

car still has the factory tune..along w the factory size tire (ss) the best mph i ran last night was a 13.2 @ 111.39 with a crapy 2.4 60' and ridding the rev limiter in fourth trough the traps....

If he's on the stock tune, the rev limiter is set to 6000, not 6500, though.
Yeah, with those tires and gears, you'll be hitting 6000RPM at about 112 mph. Sounds like you need to get that rev limiter bumped up to about 6200. Again, I don't think revving it out an extra 200RPM on the stock valvetrain would hurt anything, but you may want an extra opinion on that.
I wouldn't think a shop that has the program would charge much to just bump up the limiter for you.

I had to shift into 5th one. 4 years ago I was running 853 heads and a 218/222 cam [396RWHP] and I installed a 75 wet-shot on the car just to make it more exciting.
The car ran 10.701 @ 128.28 and I was running out of gear with 4.11's and a 26" tire at 7000rpm.
On one run I installed the 100 jets. I ran out of 4th gear with about 100' to go. Shifted to 5th w/o any problem, no grind, nothing. Car fell flat on its face. Ran 10.72 @ 127
Point is, setup your gearing/tires/rev-limiter+valve train to all work together to the MPH you expect to run with your setup.
CARTEK and I expected that with my current setup I would run 131.5 or so MPH. So we went with 4.56 gears and a 28" tall tire and a 7200rpm limiter. I trap a high of 131.48 Works out perfect.
It seems to me that you have a bolt-on car. I have driven bolt-on cars with 4.10's to 117mph or so with stock 6150rpm limiters on 26" ET Streets which do grow a bit. Never ran out of gear though...
