if you check nolo condendere aka no contest you waive your right to an attorney, yet at the same time youre not admitting guilt. basically you do not plea innocent which would involve an attorney and a court date, and you do not plea guilty. instead you plea no contest and pay the fine, and im pretty sure its recorded as a conviction.

Was reading through the thread, wondering if anyone was going to tell him. What I don't understand is, if you've pleaded "no contest", how have you not paid a fine? If you spent the night in jail, you should have a "credit" towards the fine. You need to talk to the clerks at the court window.

Don't get a lawyer. A class C misdemeanor doesn't come up on background checks. Pay the fine. You aren't going to beat it in court. He has a very small burden of proof, his word, that he thought you were intoxicated.

For future reference:

1) You aren't going to win a "pissing contest" with a cop. Ever. Don't know if you've heard this cheeseball **** from them before, "You might beat the rap, but you won't beat the ride."

2) Don't ever eat ANYTHING they give you in jail.

The police officer at the jail said that I could get a lawyer if I plead no contest.

Also, by pleading no contest, can't I still get deferred adjudication? Thats how its worked in the past with an MIP that I got, traffic tickets, etc. Thats why I chose it...

Unless you actually did something bad, no one cares about public intoxication. It's something you'll laugh about down the road with your kids and grandkids trying to teach them not to be such a jackass. lol.

Hmmm, Well, is it the same with traffic tickets? because you can plea whatever on a docket but then if you go to trial you can change your plea....

For example I went in to pay a fine, plead not guilty so it had to go to a docket, then during the docket I had another choice to plea on my ticket, but found out my license wasn't going to be suspended so I plead guilty so I could just go home. If I plead not guilty they were going to have to set up a day for a trial to present evidence etc etc.....But I was doing 97 in a 70....I was going to lose, I was just trying to work out a deal with the prosecutor so I wasn't suspended... Which I did, for the hefty fine of 300 bucks...

i work for the sheriffs office, and alot of people dont know but being a dick can land u a PI, you dont have to do any field sobriety tests, so its really more of the officers word against yours, just for the simple fact that they(the officer) doesnt have to prove it in court, besides saying you were drunk. its either sit in jail for 22 hours or pay the fine. sorry to hear bout a PI lol, lotta people get them and half the time they arent drunk =/

Dude, you are out of jail so you payed a fine to be released. If not then you served enough time to not have to. IT IS OVER go out side and play. It is not a big deal your wallet is just lighter.

This is what i dont get... I was arrested for the same thing in the summer of09'.. stayed in there all night.. got booked in in the morning because i was being less then cooperative.. then saw the judge right there in the jail... got time served and they let me out didnt have to pay a fine go back to court, no classes?? i just plead guilty and moved on with it..

Umm....Why do you have to pay a fine or anything? You are over 21 and you got a PI. That should be a night in jail and then they release you. Never knew you have to pay for a PI. Thought that was only for under 21. You should be a free man.
