Got a ticket because the cop ASSUMED I was speeding

Default Got a ticket because the cop ASSUMED I was speeding

So I was just on my way to work heading down dixie farm towards broadway when I see these two trucks in fron of me. They both have dumped exhaust, and they start revving it up. Sure enough they take off, and I just follow them, but keep the speed limit. We come up to a stop light, so I catch up to them. The light turns green, and they take off again. I know the speed limit drops down to 35, so I go 40. Sure enough, there's a cop just waiting. He goes after the trucks and turns his lights on. I kind of laugh because I saw it coming. I don't think anything of it and go on my way.

As I start to go, I hear him yell at me to come back. I'm kind of shocked and pissed, so I do the one thing I shouldn't have done, and start arguing with him from my car. I decide to just pull over and see what he wants. He finished with the truck (the other one took off before the cop pulled him over)
and he came to me. He said that he heard my car and knew I was speeding. I tell him no i wasn't, those trucks were just loud. He then says "well your friends were going 60, so I'm, going to assume you were doing the same. but I'll give you 54 so you can take DD" and he gives me a ticket for going 60 in a 35.

Needless to say i'm PISSED. Can I fight this, or should I just take defensive driving?

I would love to fight it, but in all honesty, I doubt I'd win. I have speeding tickets on my record already, and it's my word vs his, and in Pearland, the judge likes the cops. I think I should just bite the bullet and take defensive driving.

The question now, is how much will I end up paying total when everything is said and done.

My best guess is court cost plus dd. The court cost should be on the ticket or you could call and get that over the phone.

Hell with that, fight it. Is there a spot on the ticket where it indicates how your speed was clocked?

no it doesn't. anyone know off hand how much pearland's court costs are?

i'd fight it. you pulled over without officially being "pulled over", which shows you were fully compliant and really had nothing to hide. the only evidence he has against you is suspicion. he did not clock you, end of story.

You'd be stupid not to fight it! What do you have to lose?

The cop was clearly in the wrong. I'm pretty sure that if he has no proof as to how fast you were going, there is no way this ticket would stand a chance in court.

Dude, think about it. What will the cop say in court? If he says what you heard when he pulled you over, then there is no way a judge can find you guilty. It has to be proven beyond reasonable doubt. Him assuming your speed based on the people in front of you is a reasonable doubt that he knew your speed. Fight it!

if u get a lawyer half the time they will just let you win the case just because they are so swamped that they wont feel like fighting it. especially for something as small as this.


also this story is about par for the course. some cops just love to **** with ppl in fast/loud cars. they think that the F&F movies are the real deal lol. so they think that everybody they pull over in a fast car "lives a quarter mile at a time" or some ****...


haha just ask mark, he'll tell you about his run in with precinct 6.

^yeah that's why mine is A LOT quieter than it used to be. i've had many run ins with the po po. and it was mainly because of the noise my dumped TD's made.

He was a motorcycle cop. I've heard those are the worst.
