Someone can chime in to correct me but I got pulled over by a county bear (72 in a 40) and the clerk said I was going too fast to be considered for Defer. or Driver Safety Course...She told me anything 30mph over the posted speed limit that you had to pay the fine and take the mark on your record. So definetly get a lawyer for that. On a side note she also informed me that in the state of Texas if you are clocked and pulled over @ 100mph or greater you can automatically be taken to jail.

At the time I thought the speed limit was 70 and I was going 20 over so if something did happen, I would be able to get def. jud. (25 being the max you can go over) or defensive driving. The town was in the middle of the highway and when you get into town the speed limit drops to 50, and thats where he busted me.

Was this in Austin or another city?

I hope it wasn't a WILCO cop.

30 mph over the speedlimit is wreckess driving, a class B misd., so yes you can go to jail for anything 30+.

I just took defensive driving and there was a dude in there that got pulled over doing 95 on the beltway and another guy asked the instructor how that kid got to take the class because he was going too fast, and the instructor said it was all up to the judge to determine what happens.

It's 55 in that one town on 71 if we are talking about the one about 10-15 min off of I-10. I would guess somewhere on 290, that's one reason I never went/go that way.

To answer your original question:

Traffic Lawyer

Where: Bourque Law Firm
1027 East Riverside Drive

Contact: James Borque (pronounced Burk)

Phone: 512-663-9794
Cell: 512-916-8866
Fax: 512-331-2879

Great lawyer and you will get rid of this ticket (dismissal) if it was in Travis county. I've used this guy for years, I should have at least 5+ tickets on my record but it is completely clean. Call him or his secretary Terri for more information. GL

It was in mannor texas (so yes travis county). Its not the fact that my radar detector didnt work, its just the fact that I didnt hear it. This chick in my car pointed to it and it was backing down from K alert and about. Then I look back and I see a cop about a mile and a half up the road. By the time he caught up to me I was in austin. To make a long story short, I pulled off on palmer hoping he wouldnt see me and by the time he wrote me the ticket I left my lights on and the batery drained, so me and the cop flagged down a trucker and push started the car. That sucked....untill I got to 6th street.

In the State of Texas The only traffic violation you cannot be arrested for is SPEEDING. Any other traffic offense listed in the Traffic Code you can be arrested for. Although there is a loophole to all this. You cant be arrested for SPEEDING but you can be arrested for what is called "Unsafe Speed" which is defined as Prima Facia evidence that the speed was greater than normal. Its all in the Wording and titles. The Texas Penal code and Traffic law is written to confuse the common citizen. Those in law enforcement such as Police offiers, judges, and DA's have studied and deal with the laws everyday. So its the actualy how a specific Section of a traffic law is worded and defined. Like i said earlier They cant legally arrest you on speeding but they can get you for 'Unsafe Speed'
