Arrested Last night... need advice
Okay, first of all it was in San Marcos, TX (Hays county) on the access road to IH35. There was no radar etc etc. I got pulled over and arrested...charged with Highway Racing, Class B misdemeanor. I have a fairly clean record (a few speeding tickets, but nothing in the last 3-4 years at all. My motor was just finished 24 hours prior and breaking her in, so was not necessarily racing.... just horsing around so to speak with a guy next to me. I was the only one that got nabbed. The cop let my car get driven away by a friend, so that was def good news. I am not a kid here (32) and active duty air force. Does anyone know if this sounds like it can be beat? Definitely get a lawyer? Punishment to expect?
I got released with no bond, spent the night in jail, car was not impounded with no priors. There were absolutely no other charges written.. just "highway racing, class B misdemeanor.
Any advice would be appreciated

i dont know man. from what i understand and experience if they feel you were racing you were racing. like i argued with a cop about exhadition (sp) of acceleration. the officer basicaly told me if he felt i was taking off too fast even if i did not think i was taking off fast it is up to him, and it is kinda like the same with street racing. it is there interpritation but deff get a lawyer and see what they can do.

Well since I got arrested for this allready let me tell you what I was told in Comal County. I was told that I was going to loose my DL for a year and have to complete at least 10 hrs of community service. I paid my lawyer almost 1500 to get this taken away. Which he was successful in doing with the DA This is what the law states. I researched it Sorry to hear this Coker. Lets just go to the track so we dont even have to deal with this BS anymore.
• HB 1326 automatically suspends for one year the driver license of anyone convicted of illegally racing on a public roadway. This prohibition includes participation is a vehicle speed competition or contest, a drag race or acceleration contest, and a test of physical endurance of the operator of a vehicle. Before a driver’s license can be reinstated, the driver would have to complete at least 10 hours of community service. An offense under this law is a state jail felony if it is shown on the trial of the offense that the person has previously been convicted two times of a similar offense. The law also increases the punishment for drivers who are racing drunk, who have open containers of alcohol in the vehicle when racing, who seriously injure or kill someone during the race or who have been convicted multiple times of illegal racing. Those offenses range from a Class A misdemeanor to a second-degree felony.

my friend got arrested before, he basically spent a lot of money to get a good lawyer and they reduce all the stuff you get. I forgt what kind of punnishment he did but I think like some community service and maybe suspended license for a little bit

ok I got arrested for racing on highway about a month ago in Harris county spent night in jail after that first court date is to see if you have a lawyer then next court date is to see what you get i guess havent gone to second court date yet rescheduled first then rita happened but i talked to a lawyer he said since i dont have anything on my record except a couple of speeding tickets i can get deffered adjudication (probation) i think he said like 6 to 8 months but he said if i do it again its an automatic 6 months in jail and that aint happenin
