There is a law about "evidence" in plain site. Maybe he's not allowed to tell you to pop the hood, but he could look under your car and see no cats. If so, that's in plain site so the "evidence" would be admissible in court.

I got a ticket for no front plate once, I just put one on there, took a dated picture, showed it to the DA and he dismissed the ticket.

I'm also curious to know what kind of ticket the "no cats" will be? Since it's a federal offense...couldn't it be pretty severe?

It's not a moving violation so it won't go on your insurance, just pay it and go on

That's what I was thinking. I could be wrong but I doubt its a federal offense for driving with no cats. If anything it would be the dealership selling you a car without letting you know - Which could be pinned to the person who sold the dealership the car. I remember when I took my truck to carmax to see about a trade in they made me sign a document stating that the truck was emissions legal.

I know it's not like a traffic ticket, but I was always told it is a federal offense...stupid green-peace!! I'm curious to know what the damage would be for something like that.

I'm due for inspection by the end of this month...I'll probably do it next month to give me some extra time. I'm putting the turbo on now...am hooking up the oil system tonight so once it's tuned in a couple of weeks, I'll be trying to slip by the cold hands of emission laws. I own HP Tuners though...so, no SES light here !!

I'll bring this thread back to life since the last question hasn't been answered yet. What are you looking at for having no cats? I mean from what I thought for a 99 they don't have to even look under the car just plug it in so if my check engine light is off its still a no go? I really wasn't to worried b4 but now that I got my big cam omg super loud. So any kinda input for the whole cats thing?

Better yet nomorews6, go online to tdps and file a complaint on this trooper online. Not trying to knock Kevin, but I disagree bigtime with him on the inspection versus search argument. To asked to open your hood for inspection is a search, plain and simple. The officers conducting stops for these reasons are mixing commercial traffic code with those that apply to the private citizen. There is a reason we pay for annual inspection stickers, troopers need not waste my tax dollar money for catalytic converter stops. That is a pollution issue, not public safety, violators will get caught or comply come the next inspection. True, a DPS trooper can inspect the outside of the vehicle for conformance with the law, but he has no right to arbitrarily tell you to open the hood for inspection to check without cause. Always refuse the search, always! If he tells you it is inspection and not a search, tell him he is wrong and that he will need a warrant. Ask for his shift seargent to showup, especially if he is inclined to arrest for your refusal. Your rights are worth going to jail for! Do not lie down for anyone! Remember that in the field during a traffic stop, police will interpret law as they see fit, because they want you to comply, and raise revenues for their respective agencies. Police are not legal experts, they do not know all the laws, nor do they always enforce the law as it was intended to be when it was written on the books. Six months of police academy training makes you an expert at nothing, a law degree makes you a legal expert, trust me I know. I have written my congressman on this issue and have not heard back as of yet. I wish I had gotten pulled for that and not you, although I am compliant with emissions, I would have refused. If he arrested me, I would simply file on him the next day in civil court, naming him only, not his agency, for official opression, and ask for the absolute minimum in damages. I beg you, file the complaint, he is doing this to more people than just you and your friend, he is being predatory and that is definately questionable ethically, he deserves to lose his badge if he is going on a bender with those.

nomorews6, since it was over three months ago, what became of it?

I got a "no cats" ticket in Las Colinas and decided to go to court instead of just paying it. When I met with the prosecutor she offered $220 so I took it instead of fighting it. I think the original ticket was like $400-$500.

since this thread has been brought from the dead, I figured I'd update you all I just brought in a receipt I got for the cats & they dropped it. NO sweat! My buddy came in with me that was pulled over also - fyi - for the second time and he was let off too.

I send all of my tickets to an attorney and they get dropped every time. $40 a ticket, you cant beat that.
