used car lot not paying off my car purchased from me and my rights....

Default used car lot not paying off my car purchased from me and my rights....

I'm simply looking for my rights under the law in this case.


I sold my car to a used car dealership back in Feb. My pay off was good till 3/8/07. I have a signed statement/documention saying they will pay off my car by this date. It outlines money to be paid and money I paid. I paid them 500 to get out of the car by Credit card so i can prob. get that back if i claim it with the c/c company. I was ahead on my payments so my March payment was paid already. Now I'm getting my April bill.

What are my rights under the law about this wonderful situation?

Have you contacted the used car lot and your lender,
and discussed the situation first?

I have contacted the car lot 4 times over the past month. My lender has copies of the paperwork and they have 3 phone calls logged with my statments over the last month as well. However, the car is still in my name and I am still responsible over all until the payoff is paid.

The car lot just gives me the run around. I'll be driving over there in 20 mins to see if I can get a better responce in person.

If your car is not legally sold and they have breached an agreement in writing, simply point it out IN PERSON. If they do not get right on the ball, tell the person in charge that you will have a police escorted tow truck coming to reclaim your stolen car.

+1 if you cant get it through their thick skulls let them know the police are coming to get YOUR car from them since the car is still in "YOUR" name and YOU are still receiving bills for it

The problem here is, I do not want my this car back after someone has been ragging it out for 5 months and racking up miles. I want the dealship to own up to their agreement of which has changed 3 times and I accomodated them.....

ok here's the deal


I found out they got 12500 for my GTP It was an extremly clean car but WOW)

My pay off was 7700. At the time they wanted me to pay 2000 to get out of the car (which was the 2nd time they broke their agreement). I did not know how much they sold the car for at that time. Anyway I told them 500 was the most i would pay end of story. They took it. I forced them to sign an agreement they would pay the 7200 + the 500 I gave them by 3/8/07.


Lets look at this a min....


12500+ 500= 13000 for my car. They are telling me they are loosing money on this deal? They made 5300 dollars on this deal!!!! WTH am I missing?

Maybe I am missing something, or a couple of things. First of all, how did they sell a car that wasnt titled to them or even paid off through your lender? Secondly in the first post you said you sold it in Feb. and now you are saying that someone has been ragging it for five months. Lastly what they sold the car for has no relevance whatsoever. Thats their business. Why in the hell did you turn over the car to them with no pay off on the spot? There are a few holes in your story bro.

How did they transfer the title to the new owner? Even if you are not serious, tell them that there will be a police escorted tow truck on the way if they dont get on the phone and transfer whatever is owed right then and there.

I guess i have to tell the whole story so you understand. I dropped the car off in Nov 2006 at the lot as a consignment. I called over the next 2 months 3 times tto get a status on the car (never got the manager left messages).I got fed up with this and the last time (in Jan) i actually stopped by. Found out the manager was fired and got a long song and dance about how they had my car sold 2 times and the person was driving it. They lost my contact information. The new manager said they could not make any money on the agreement I had with the previous manager and I said fine just pay off my car and I'll be happy. They called me back in, in Feb. said the car was sold and wanted me to pay 2K to get out of the car..... This is where you know the rest.

It's a long story. Per the agreement they were suppst to pay off the car by 3/8/07. they did not. There are no holes in my story I simply left some of it out. What they sold the car for is relevent. Because per the agreement there was not statement saying they would make XXX amount of money. It simple was they get any profit over the payoff.....

Right, consignment you pay them a set fee to have them sale the car. They are trying to make double back on it. This sounds like a big cluster f* to me with the dealership right at the middle. GL.

fi they sold the car without clean title to it as a dealer, then they have a problem ..


if they sold the car as a middle man, negotiating the deal for you, then the buyer should have paid you, and you paid them a fee.

If what you are saying is what occurred, and you are not leaving anything out, then call the authorities, as them what to do ..


did you sign the title over to them ? if so, what does your bill of sale show ?

Man alive, what a messed up deal. You need to make a serious threat of bringing an attorney in. And if they dont get it handled, file suit. For future reference, leaving things out = holes in your story.

Eventhough they fired the guy, they still need to honor his agreements. He was an "agent" of the company. Hopefully you have some proof as to his "agreement", ie. something in writing, witnesses...
