Default what is the law about guns?

ok my friend had his life threatened and wants to know the laws about guns here in texas. Can he carry a handgun in his truck or does he need a concealed handgun liscense? thanks for the info and please make sure its the law

You can carry in your car as long as it is concealed.

tell him to get a motherfuckin shotty... i used to keep a shortened youth 20gauge velcroed to the roof of my T/A, along with a ballpoint hammer on the door panel for hand to hand.. Gotten myself into too many situations over the years to not roll around strapped.

As far as the CHL and handgun thing.. i am uneducated on the laws.

with the new law, he can have it with him in his car.
concealed and all if I am correct.

But has to be in car, not on him. If on him, he needs a chl.

Pretty much if you're in your car and "traveling", you can have a firearm. Can't carry on your person w/o a CHL. You'll have to check the new statute to see the legal definition of "traveling".

You can carry in your car without a CHL. Chambered and ready to go. I have confirmed this with local police, sheriffs, and DPS.

Starting Sept 1, 2006 (i think was the date), Texas changed the law on carrying a handgun in your vehicle. Prior, you had to prove that you were traveling to justify carrying a handgun. A good rule of thumb was crossing 3 county lines. The way the law reads now, you are assumed to be traveling unless proved otherwise (and thus able to carry in your vehicle). Basically, it is very unlikely to be prosecuted under the new law because the burden of proof is on the state. So it is still a little gray, but it is generally agreed that you can carry in your vehicle.

The smartest thing to do would be for your friend to take the CHL class and research the laws. Without a CHL, there is no legal way to carry outside your vehicle. A CHL is not very expensive and there is no question whether or not it is legal.

There really isn't one. You can get in your car and move it across the street and you would be "traveling."

I know you can carry it in your car with but I am pretty sure they passed a new law in 07' saying it couldn't be loaded.

Im on probation right now for that same reason. I was pulled over cause some one reported my car. Upont inspection they found my S&W 9mm with 16 round clip fully loaded under my dash. . I got to spend the night in jail. Oh well, they had real nice coffee and sweetbread. LOL

You may poses and carry one, if it is conceled. No CHL is required. BUT, there are very strict restrictions to this. Such as, it must also be conceled while in transport from home to car, or car to car. You may legaly carry and concele any firearm loaded or empty, its your choice. My suggestion is visit http://www.txdps.state.tx.us/ for complete understanding of these new laws.
THats about as good as I can do at the moment.

We both walked down the same path at once except that I had the exact same thing happen to me in 2000 right before they made it a Felony. It was just a Class A Misdemeanor for me at that time, if this would have happened any later they tell me it would have been a felony. I'm glad probation, fines etc are over, and glad you had a good meal there cause all I got was a icy cold ham and cheese sandwich with some room temperature milk.
