Got my first speeding ticket, what should I do?

Default Got my first speeding ticket, what should I do?

Here is the story.

I was driving down I-10 when I got stuck behind an 18 wheeler throwing rocks and debris on my car. I got in the left lane to get around this guy and a cop was sitting there on the left side of the freeway. Since I was behind a 18 wheeler I could not see the cop there and he got me.

He clocked me going 77 in a 55 on I-10 as I was trying to get out from behind this 18 wheeler and said I was in a construction zone.

My ticket says $430 for doing 20+mph over the speed limit in a construction zone. On the other form they define a construction zone as having workers present which in my case there were none.

Also there were several cars going close to the same speed as me. I saw the cop turn his lights on, got in the middle lane, let a few people pass in front of him then rolled his window down and flagged me to pull over. I guess a red LE Camaro stands out.

What can I do or should I fight this at all. I know I was speeding but I don't think I should have to pay a $430 fine when there were no construction workers present.

Welcome to the club!!

you should give them a call and see if defensive driving is an option for you if not i guess youl just have to pay

If you can take defensive driving call laugh spot and take comedy driving it is worth it or at least the several times I have taken it. 281-955-9200 its worth the try.

Do workers have to be present for it to be considered a construction zone or be ticketed as one?

I'm giving you the best advice out there. He's got a website, look it up. He's been used by MANY members here. He kicks *** with traffic tickets. Call him (or another established traffic attorney).

OR

try to fumble your way through it and hope you figure it out or get lucky

OR

Go pay your $430 AND have it on your record.

I suggest you listen to people who have been there, done that.

If there were signs saying it's a construction zone....its a construction zone. Your **** out of luck. Try and take defensive driving but I don't think you can when it's school zone or construction zone. I might be wrong though.

uhhh, not exactly.

couple people have said this, so just wondering...you guys have noticed that the sign says:

Construction Zone - Fines Double

When Workers are Present.

If you can prove somehow that there were no workers present than it should go down to $215.

I got my first speeding ticket 3/11/08. I was only doing 63 in a a 50. **** happens.. Especially when you have an LSX

OH YEAHHH! forgot about the When workers present part. You just might be in luck...kinda sux though the cop put down construction zone on ticket. You can take it to court and hope he doesn't show up.

you should be able to take defensive driving and get it dismissed....will cost you a little over $100. unless they've changed the rule within the past year, you're eligible for DD as long as:

1) you didn't go 25mph or higher over the limit (you're good there with 22 over), and
2) it wasn't in a school zone (you're good there also).

just take DD.

This doesn't apply for him but you cannot take DD in order to dismiss a ticket more than once a year unless ordered by the court.

I'm going to see if I can take defensive driving. If not I may give David Sprecher a call.

Does anyone know if taking defensive driving takes the ticket off your record or just lets you escape from paying the fine?
