Default CA residents please help! i think i got harrased!

ok.last night i got pulled over on my car and the excuse was that i did not have a front license plate on my vehicle! the license plate was on my right side of my windshield...ok now where i think i got harrased...the officer asked if i had any thing illegal under my hood..i replied by tellin him that nothing under my hood had to do with me not havin a license plate.he did not reply but he popped my hood open and noticed my nitrous line.the bottle was not hooked up and neither was the nitrous line hooked up to my intake elbow.(pic included) now i have to go to the state ref!!!! what should i do? did he have the right to check my hood with out my permission? can he check under my hood if he pulled me over for my nitrous lines that arent even hooked up to my car? i got violation 27156

How much is the fine? What is the charge? I'm not a lawyer but I think I'd hire one (depending on the amount of the fine). It's an equipment ticket right? Not a moving violation. Shouldn't affect your driving record. Somebody please correct me if I'm wrong.

well its a ticket where they send you to the state ref which checks that everything in your car is legal and that it passes smog.without takin it you cannot drive your car! you can pay the ticket to get out of it which is a fine for 300$.not much but i think i should not pay for somethin that i am not guilty of!

to put it shortly, yes everything he did was kosher, ( a little but of chicken sh#$ though if you ask me)

You did give him probable cause by saying " replied by tellin him that nothing under my hood had to do with me not havin a license plate" Next time a cop ask you if anything under your hood is illegal say "NO sir"

By the way how did he pop your hood unless you let him? By the way thats not a way to get around this type of stop, the cops will just impound your car and give you a bigger ticket for f-ing with them.

If you know your car will pass smog, take it to a state ref. to my knowledge having nitrous lines(as long as not hooked up to a bottle) is legal. BUT I may be incorrect. To find out call a state ref, "anonomously" and ask.

Good Luck and welcome to the communist state of california.

i was also under the impression that as long as the lines are not connected to a bottle, it is legal to have installed in the car.

The cop can give you a modified emissions ticket if he feels something may not be up to par, he is referring you to the expert to make the determination. All that means if you have to go to the state ref and he will make the determination if everything is legal.

If you go to the ref and he says you fail you have to get it repaired before you go to court or they suspend the registration on the car. and you pay the fine. If you pass the ref then you pay a minor court fee.

27156 if for removing/tampering with pollution control devices, not for the nitrous

Nah, what he did was legal. Should have just been nice to him, like stated above. I got outta a $5,000 fine for no cats cuz i was nice and cooperative to both officers.

When u take it too the Ref make sure everything is hooked up, (plug in the maf), don't try to hide the line, etc. Most u'll pay is the $70 ref/court fees.

What he did is sadly legal =\ they're allowed to search a vehicle if deemed "modified" to them.. time to clean up the kit and work the lines better =\ But like the guys mentioned above it is fine to have off-road-use products in your vehicle especially if they're not hooked up. you can pay the ticket off or you can take to a rep and pay a lesser fine.. if your car is boarderline passing emissions you can run it up nice and hot before the rep gets it and change your oil before hand.. that'll help reduce smog =\

best of luck

You hood doesnt qualify under the 4th amendment because it is not a compartment for storing/passenger compartment, there are vehicle codes that allow an officer to check your vehicle and falls under emissions laws, however your out will be in who gave you the ticket, if it was a CHP then your screwed because they go to special training on recognizing vehicles with emissions problems and unsafe vehicles, so you are going to have to try and see if he hasnt had the training to specify if a vehicle is smog legal.

Also on the front plate thing, vehicle code 5200 states your license plate has to be attached to your front bumper, inside your windshield is not attached to your bumper.
