Default Virginia Speeding Ticket Help

I got a speeding ticket driving through VA tonight (im from MD). I know full well the the VA cops dont play around but i wasnt cruising at a fast speed, he "radared" me right after I got done passing someone. Heres the details, the speed limit was 55, it was a two lane highway (one lane goin east, one lane goin west), i was in a passing zone, and the car in front of me kept slowing down/and speeding up (45-60 mph), it was almost like he was drunk. So, for the sake of safety, i speed around him, i told that to the cop and he said that even if you are passing someone, you cant go above 55, i understand that but do you know how long id be in the other lane if he was going 50 and i was passing at 55, at least 5 seconds, and thats way to long to be in the other lane. So my question is, do you think id have a chance in beating this if i go to court? Im 25, military, and ive got a clean driving record.

Oh yeah, he said i was doing 72. SO its a 72 in a 55. I know it seems fast but keep in mind that i just wanted to get back over.

I doubt you'll be able to beat it totally. Alot of times if you go to court they'll reduce it.

Just be happy the virginia fines only apply to virginia residents (or are you a resident..?)

they had to repeal the crazy resident only fines thank goodness. Good luck, I would atleast show up at court and make your case. I bet they atleast drop it down some. I drive a road like that everyday to work and pass people occasionally, no run ins yet though.

Yeah, just go to court,Va is all about MONEY they'll drop it {point}. and pay fine.

good luck if you do, i heard from my personal friend's experience that a lot of the judges are ****** also. i hate VA police, there is a fine line and they are way over it. i will never drive through there. i never got a ticket from that state but a lot of people i know have. i'll drive around or fly if i have to go somewhere.

Yeah, I called the court today and asked if i can appoint someone a power of attorney to appear in court for me since ill be in another country and they said yes. So my dads gonna go to court for me with a signed statement of the events. Im hoping that the judge will see a father going to court for his son, whos in the military, and hopefully the judge will go easy.

To answer the other question, no im not a resident, im a resident of MD.

what county courthouse do you have to go to? If it is fairfax they probably wont let you off

I had the exact same situation about a year ago. I was behind a f350 dually going 55ish in a 50. The truck had a flat inner rear tire that was hot enough to smell,so I wanted to get out from behind it before it came apart. As soon as I passed the oblivious cell phone talking woman, I got radared. Got a ticket for 63 in a 50. Went back to Va (47 miles)for court and told the judge the exact story and the officer admitted that was what I told him. The judge says "Well that IS what they teach you to do"... Then he promptly told me if I wanted the ticket to go away I had to go to an 8 hour trafic school. A$$hole!!

Not Fairfax, it was Westmoreland, it was a deputy that gave me the ticket.

I wouldnt mind going to traffic school but it would cost me about 500 bucks for an airplane ticket and 1 week of leave, so i think ill try my luck with the power of attorney thing.

You can ask for Driving School from the prosecutor, you can take the class anywhere and then sent the certificate in when complete. I did this,
I HATE Virginia, the State guys would give there own mother a ticket, they are bastards. Everytime I am out driving I am followed by a county or state trooper, it sucks

you going to hate coming back, I was at Freidricksfeld near heidelberg
I loved it there, the Polizi are more interested in public safty than revenue or trying to be tough.
