Default What to do if former employer will not give you your W2?

A small business I worked for this past year has yet to send me my W-2. I've called multiple times and gone in to talk to the owners about it and I never get a response. I would like to send my taxes out but I've been waiting on these douches. What should I do?

By law if they took out taxes on you they must send you your W2, they can get into serious trouble with the IRS. Be patient, you'll get it.

I'm pretty sure they legally have to be post marked by the 31st.

I know they have to be postmarked by the 31st but everyone there has recieved theirs already and I'm getting the cold sholder when asking about it. I ended work their on a sour note, but I'm sure as a business they don't want get raped in the *** by the IRS, unless they really are that stupid.

You are correct. They have done nothing wrong up to the 31st when it must be postmarked by midnight to be in compliance. They should have them out sooner out of courtesy (ours went out a week ago to all our employees), but you are S.O.L. (still on land) until long enough time has elapsed for regular mail to get to you.

A few years back, I had to go to the IRS website and file a simple grievance ... was just a form. The IRS will notify them and and you'll receive it quick ... within days ... at least that was my experience and I don't think that has changed. Good luck man.

Not to be the one to bring bad news, but they can get an extension on sending them out too. I had a former employer do that to me a few years back. Check with the IRS, they will tell you that they don't have to be post marked by the 31st if the company files for an extension. Good luck.

There is an IRS Form requesting a copy of your W2, get it off their site. File it and you'll have it by 4/15. If they dont have it then they will send a demand to file to the employer.
