Well I was coming home last night and started to drift asleep and nailed the hell outta a guard rail, snapped three posts. The bird may be totaled, I nearly died, I was cited for failure to control and on top of that I was arrested for DUI because I had 2 smirnoff ice's and a miller light a few hours earlier! If the car is totaled I will be parting it out. The bags deployed, cracked windshield, trashed front end plastic and sheet metal plus a screwed hood, i'm flipping out. more later....

Whether under the limit or not, you drank and wrecked so it will be an uphill battle. Best of luck to you and sorry about the car, however you should know not to have even one beer and drive.

Sucks to hear man. But I can't feel much pity for you, sadly. You should have taken a breathalizer to prove your not drunk, get it down to a DWI or something instead of a DUI. And don't fricken fall asleep! Blast some german techno, stop off at a gas station and get a red bull, anything!

i just use crack to counter act the depressant effects of alcohol, maybe you should try that next time

Ya I know it was all crazy and stupid, but I still got screwed unfairly. I had the drinks hours earlier, and I passed the breathalyzer! But he got me cuz I guess I didn't do up to par on the pen test. But it's messed up cuz I had just had a airbag blow in my face knocking the hell outta me and had that powder in my eyes, my contacts were all dried out and crap. Ya it sucks I know. I was in the country so there was really no where to stop to grab anything and I felt pretty much ok, the tiredness just hit so fast I didn't even realize it till it was too late.
Still it's not like I didn't screw up to I guess, stayed out to late, driving in a new area, just not being careful enough.
But atleast i'm ok, and most all the car is good for a part out, especially the drivetrain, car drives fine, just looks like hell up front.. I just hate this cuz there goes my insurance and all my discounts. But I still have my license since I passed the breathalyzer. Now I just gotta sell a bunch of my stuff and raise money fast, i'm supposed to go to court tommorow, it's all messed up, I feel like hell.

You guys say that he was stupid about all this, but show a little sympathy!! I was stupid back in 05' when I let my idiot cousin run my mint 92 Camaro into the back of a lady's car, but things happen. Good luck man, hope everything works out.

You may not be a fucked as you think. Field sobriety tests *typically* are not admissable as evidence, only the Intoxilyzer 5000 (the big machine at the Police Station) and blood tests are admissable. If both of the tests were field tests, as the HGN and a portable intoxilyzer are, you can't be convicted of DUI. You blew and you passed an intoxilyzer, if even a portible. The HGN test isn't ****. Don't sweat it.

You should definetly get a lawyer or at least talk to one before you go in to court. My buddy wrecked his car after having 3-4 drinks a few weeks ago and got a DUI and all of that. Went to the lawyer the next day and the first thing the lawyer said was, DO NOT GO TO COURT until I tell you to. I don't know what all is involved, pretty sure if you hire a lawyer then he'll go in your place and stuff. Anyway my friend is getting his DUI off his record and got it reduced to something besides a DUI for the insurance stuff so now insurance covers the wreck. Another friend of mine had something similiar happen a few years ago when he wasn't even 21 and with a good lawyer, same results, only lost his license for a month and insurance covered it all blah blah.
Bottom line, GET A LAWYER NOW.
