Question for some IL locals...
Have any of you ever been given a ticket for crossing railroad tracks while the lights were on but the gates were up? I knew there was a law about this, and a hefty ticket ($500), so I always wait to cross... but what about if you are unable to stop in time? A buddy of mine just got nailed for this in his little podunk town because he was sure if he slammed on the brakes the soonest he would have come to a halt was on the tracks. He was driving his 2500 Ram that weighs in close to 7500 lbs, and it was wet. If anyone knows if there is a set time between when the lights come on and the gates come down, what that is, or have heard of anything like this occurring before please post. It's a mandatory court appearance, and he is going to fight it with the best he's got.

He could argue it in court, but they could always come back with him going too fast for conditions if he brings up the rain. They should let it go, but you never know who you are going to get. BS in my opinion.

Yikes! I had no idea that you could nailed for it. I figured if you crossed and tried to beat the gates coming down, but I mean, what if you were already right about the go over the tracks and the lights came on? Technically, you could get a ticket for that, but what choice do you have? Slam on your brakes and stop on the tracks?

Yeah, we understand that the law is the law, but why have a delay from the time the lights go on to when the gates fall? Best he can do is hope to prove that he couldn't have stopped before the tracks, driving below the speed limit.
