Default drinking WHILE driving

What would happen if a cop pulled you over and you were drinking a 16oz tall boy.. not like he walks up and its in your hand but just humor the situation.. Someone i know does this and says if he gets pulled over its just a "ticket".. Im pretty sure there is prob. some jail time involved.. Would like to hear from some LEO's or people with experience.. Thanks

a buddy of mind got pulled over in Galveston, cop SAW him take a drink out of a 32oz.
It was his first beer of the day, he got pulled over and cop poured him out.
He got a ticket for open container and off he went.

On his court date all he paid was $235 fee.

Not sure how the law is in Houston though.

Im not encouraging any one to try this how ever.

I used to ride with State Troopers in Texas and we arrested people for open alcohol and we arrested a guy who was walking down the access road of a highway walking like he was flying due to his drunken state. He was arrested for public drunkeness. This was in the Rio Grande Valley.

In Aruba I had a beer in my hand when I was grocery shopping, walking into the restaurants and pretty much anywhere. Drinking and driving there isn't an issue. The only thing is that the rental cars void your bought insurance if you take it. Meaning if you crash while drunk it's on your own insurance. Mine covers me. Some of the folks were smoking weed while driving and cops were talking to them at a light and they were all laughing.

there are two things you can not go to jail solely for. one is for speeding and the 2nd is for having an open container in the car. but if you have been drinking from it, then there is no reason he cant arrest you for public intoxication. there is always a way around it. and laws like this is not city or countly laws they are state laws so it should be the same throughout the state of texas. i think my info is right, i got it from one of my CJ teachers but i may have some things tweeked a bit. bottom line, dont risk it, you'll prob find your way to jail no matter what.

huh doing this in SA.... and people wonder why so many damn people have been killed by drunk drivers in SA going the wrong damn way on the freeway.

either way ticket or not your friend is a dumbass

Mmmmidunno

I don't see a real big problem with someone grabbing a 16oz beer on the way home from work. It's the people who drink 20 beers at the bar after work and then try to drive home who end up doing the stupid **** you mentioned above.

I agree with the whole thing on the quantity you drink.. The only problem imho is the fact that he thinks he wont get pulled over.. I mean why risk it.. he drives a 98 suburban 4wd 250k mile beater for his DD.. He got pulled over in SA for driving through a ritzy neighborhood.. Knowing that idk y he still does it.. Just trying to save him some trouble.. I mean who really likes to be hassled.. Just wait till you get that **** home imho

Here's a twist to the question. What about if all the passengers have been drinking, there are open containers in the vehicle, but the driver is the DD and doesn't drink. Who recieves the ticket? The vehicle driven is actually one of the passengers who is drinking.

Quick-im pretty sure the passanger will get the ticket, not the driver. Its like if your the passanger and your buddy gets pulled over bc your not wearing your seatbelt. You would get the ticket, not your buddy.

wait so let me get this straight. i can get off work at 5pm, go grab a beer. drink i ton my way home. get pulled over. officer sees the can. asks if its mine. i say yes im drinking it. i get a simple open container ticket and im on my way home?

I believe it's an "open container" ticket but couldn't say for sure.

I may be a dumbass then. But I do know the difference between the possessive word "your" and the contraction of two words "you're". I am also aware that drinking, then driving isn't a crime. Yet, getting drunk and driving is.

People who think like you do are part of the problem. Please, stfu.

I wonder how many this fellow had? I was leaving my neighborhood Saturday night and this truck was just stopped at the green light so I had to go around it. Went to blockbuster came back and the truck was still there. I got off to see what was up and saw this clown.

Truck was running, lights on and in drive.
