what exactly are the laws about drinking n driving

Ok so i have a basic understanding, dwi means you blow over a .08 and DUI is pretty general about various drugs and alcohol but i was curious at what point would the cops not do anything to you, say you have a beer and drive home a little later and get pulled over for speeding, you blow a 0.01 or something like that but pass the field test fine? Im curious about this cops please chime in

It depends on your weight/build. If you're a 105 lbs chick, one or two beers may get a buzz started. For the average male weighing over 160 lbs, one beer really shouldn't do anything.

truth is if you drink anything and speed ..AND kill someone because of the speed ..the drink will put you in JAIL ...real jail with sub-humans you really can't comprehend...you think it can't happen but let me assure you it can..I've been in corrections and seen young people who would never think of breaking any law that would put them in jail wind up as damaged individuals for the rest of their lives.......it can happen

as the OP asked first is the FSB that gives an indication of intoxication, next would be the eye test to see if the eyes move smoothly if there is an eratic motion there maybe drugs/alcohol if the officer feels enough PC then an intox is given to confirm the PC here is a link to help BTW damn good lawyer ex cop

I'm pretty sure that's wrong, I thought DWI is driving while intoxicated, ie you are over the limit and will be arrested. DUI is driving under the influence, ie you're under the limit and it's up to the officer to determine if the substance that is influencing you is the reason you are driving in an unsafe manner. It has nothing to do with age.

i know most of whats posted and agree with it, im really just curious if you blow a .02 or .03 but pass all the other field tests then are you going to get a dui anyway or is it at the cops discretion because technically you are under the fluence if any substance is in your body that can affect it...so to simplify if you blow a .02 or something really low can they give you a DUI

True. But once the cop has you out of the car you technically could get a PI. Best advice I can give anybody who legally is drunk and is dumb enough to drive, when the cop pulls you over, have a 1/5th or so of your favorite liquor on hand, before he even gets out of the car, open the door..get out..and look directly into the dash cam and drink as much out of the bottle as you can before he stops you. That way he can't prove you were drunk when you were driving. You can say you were drunk "AFTER" getting out of the car.
They get you on DWI because they know you haven't drank anything SINCE you were stopped and before doing any field sobriety tests or blowing into the breath tester. Worst thing you can get is a PI. Just a little good info if you know you're DWI and getting pulled over.
