Default Question about a situation.

Today at work the manager got me a little mad. He told me, not asked. Told me to clock in early (10min) I refused and said no I'm going to wait for my time. *smile and smirk* He gave me a look and asked me.. You're not going to clock in? (raised voice)..... I said no... U can't make me. He said that he could fire me for insubordination... I said. How? I'm not even on the clock, I could just walk outside and act like I'm not here..... At the end I clocked in beause the other manager asked nicely lol.

My question: can he really fire me if he wants me to clock in before my time? Or make me stay passed my schedule?

Probably not. But he would just say he fired you for a different reason.

He has nothing on me. He's always mad and he is probably trying to get rid of me because I don't let him talk me down. He is always in a bad mood. Ex army guy so he tries to be all strict and stuff

They really don't have to give you a reason for firing you, They could just fire you just because your help is no longer needed.

It sounds like he has was having a power-trip, but remember that he has more power than you, and you will lose these fights.

Sounds like a typical ex army guy, all bark and no bite... Lol.

he could fire you for whatever he wants, he is the boss. I would just chill in my car until it is time to clock in, or just do it and work,as hard as possible to make him look like an *** to his superiors.

True. I could get fired for no reason. But wouldn't I have to be on the clock? Because if I'm not, it's like I'm not there.

He would just fire you for no reason while your on the clock.

Businesses have a lot of power over their employees.. And with California being an "at-will employment" state, they can let you go for literally no reason at all.

Maybe he needed help so he wanted you to clock in a few minutes early. When I use to work for movie theater, my manager would tell me to clock early sometimes to help out with cleaning, or restocking etc.

Depends on why he needs you to cloak in early. But, if he intends for you to continue to work your entire shift, he has to pay you for the time you clocked in early. He cannot by law, make you start work early without paying you for it. Unless, he lets you go home early to make up for it.

I did give him an attitude because the way he told me. He is an EX army guy and he has a stupid attitude. I like my job but I'm not a brown nose either.

He wanted me to go and help offload a flight. I told him for what if just going to sit there. And true! I waited for 10 before we left lol

yeah bro, try and conserve your job. I've been unemployed for over a year now and its a bitch to find anything that pays enough to cover the bills and toys. At the same time talk to that f#cker and tell him youre not a kid, tone down the attitude and you wont mind going out of your way and doing a little extra work.

I'm a small business owner and after reading your post, you would be in position to be black balled. Call it brown nosing or whatever you want to but the fact of the matter remains you let down the company you work for by not getting started those measily ten minutes early. I HAD an employee just like you and saw this "I work my shift, no more no less" attitude and it affects those around that are busting their butt to make a difference. I'm not saying totally cave into the man but wait until it's your time to bring any personal issues you may have with him to HR.

Next week there'll be a thread; "I mouthed off to the person who writes my paycheck, anyone know of a McDonalds that's hiring?"

My boss used to tell me to come in 15 minutes early to clean up metal shavings around the CNC machines, and start the bandsaw for the day's work, and stay later to do the same before the night guy showed up. I'd be there about 9 hours yet was paid for 8. The other guy that sat at the table until 7:01 in the morning was first to go when it came to lay-off time. Yeah, nobody can tell you to do anything. You're an adult. Take the initiative and be a better employee, and chances are you're less likely to be treated like a little kid, in the long run.

I'm salary and work until 7 PM sometimes to get the job done.

I'm not getting overtime or anything either.

Why didn't you want to to clock in? Even if you were going to have to wait, that would have been 10 minutes on the clock.
