Default am i in the wrong

I let someone take over my payments on my 02 ws6. Its been 6 months. The Guy got it for his girlfriend. Needless to say they haven't made a payment in 2 months. I have been hounding him since day one to put it in his name so I could get my name and credit off. Today I went down and paid off the balance past due and told him I wanted the car back. It is in his ex girlfriends possession and she moved and I couldn't find her today.
So I called the Guy he acted like I owed him since I was repoing the car. He said he wouldn't help unless I gave him something.

I made him sign a contract when he took it that leaves them no rights if the let it go into default. He is supposed to get it from her tomorrow and bring f it to me. He wants to pay me what I had to pay to catch it up and put it in his name. I told him he ready had enough chances to do that and I was going g to keep it

Oh and that mint condition is gone his ex backed into a wall or something and scraped the side of the car. Don't know how bad it is but ill see tomorrow

Go get it and cut your losses while you can. Never let anybody take over payments, even family.

Sorry but your mistake was letting someone take over the payments. If they could afford the car they could have gotten a loan, gave you the money to pay it off and start making payments on their own lien.

The funny thing is is the Guy is loaded. He has a ******* monster truck (literally ) in his driveway a Ford. F550 or some **** a brand new ctsv and 2011 jacked up f350. All sitting in front of his like 300k house lol.

Shouldn't have given them the keys without the bank being involved. "Taking over payments" means they get a loan for what you owe in their own name and the bank they get the loan through pays off your loan.

They couldn't even register/insure the car right without the loan being in their names....so this was illegal in multiple fronts in various ways.... not only being incredibly dumb on your part. And like you said, now you're getting back a car that is not the same....WTF wants a busted Fbody and now you also have two late payments on your credit report.

This will have lasting consequences for you, and absolutely no consequences for them. Totally worth the six months of payments you lost out on. What was that six months in payments....7-800 bucks on an older Fbody? You'll have more then that in to the car fixing her mistake.

I knew I had this coming and agree it was a horrible decision but its too late to cry about it. It'll be fixed soon and I've got a paint and body Guy ready to go

None of this means that he is loaded. I could have all these things if I wanted to and be in an insaine amount of debt. Which is probably why he wanted to take over payments in the first place. Good luck with the car and be sure not to judge people by what they have.

You seem to be in the right here. He failed to handle his end of the contract and if is in the contract you can and should repo it and pay him nothing. If he makes threats, get the cops involved.

I feel bad for you but yeah, you are in the wrong... because you got into that situation. I would never knowingly set myself up to be on the hook for other people like that. Maybe it's a lack of trust, or maybe I'm just a realist... but I feel way too many people are irresponsible knuckleheads.

You might be drawing the wrong conclusion. He is probably not loaded. He is probably up to his eyeballs in debt. Or...every one of those vehicles might have a guy like you behind it who got taken advantage of.

People who buy their Girlfriends/boyfriends Vehicles or Houses are all Idiots IMHO, I wouldnt go in half or even pay in full a large loan for someone else unless I was freakin Married cause without it when they leave its a bigger mess to untangle. I'd get the vehicle back then sue him for the damage cause he is an idiot.

alright update. today he tried to tell me he'd get it for 500. i told him i would not pay him anything and that she had 2 hrs to give me the location or i'd file it as a stolen vehicle.

well then he started to try and go legal on my *** saying that she paid me i paid the car lot with her money and it was my word against his................WHAT!!!!!!!!............then he said that since it was paid up i couldnt come get it, then he said i should have sent her certified mail, then he told me that since it was caught up and our contract was in his name that he would just keep making the payments and keep it............

At this point i just started hanging up on him and was on my way to the car lot to let them just find it and repo it, because you know that is the one thing they are GREAT at lol.

on my way there he called me. I answered. he told me he was ******* with me and he had picked the car up last night from her and would meet me here in an hour to hand over both.

Is it just me or is this fishy. kind of wierd to all of the sudden he is being nice and just handing it over. maybe he realized he wasnt going to get anything from me. Or realized that i was going to report it stolen and since he was on the contract that he was liable. I dont know but hope it all goes well. ill post up when i have it back (all in one piece I hope or its court time)
