: Texas is a one party state, which means that one party to the conversation may give permission to tape record the conversation. In this instance you agree to tape record the conversation, and you do not have to have the permission of the other party to record it.
While state law does prohibit interception of communications under some circumstances, “interception” is defined as recording the conversation without the permission of a party to the communication. Texas Civil Practice and Remedies Code Sec. 123.001(2). Since you are a party to the conversation, you can record it.
There are also federal restrictions on recording, but, like Texas, they are one-party restrictions. There are some additional limitations such as not recording a conversation with the intent to commit a crime or a tort, but cases have held that recording conversations in the course of newsgathering does not violate those provisions.
While as a matter of courtesy you might advise the person on the other end of the line that you are recording the conversation, but in Texas you can record your conversation with them without their permission.

guys a douche, a homo, a shitbag. Definitely keep us informed on what happens legally to this kid. I'd love to go to his house and show him the way to handle things man to man but it wasnt my money he stole so I couldnt justify it. I'd definitely go to watch someone work things out with him though

I did a 3-way conference call with myself, Adam, and Pat. I called his house number and asked for his father and Pat picked up. I then proceeded to talk to Pat, told him who I was. Pat asked me "why are you guys making these threads on tech?" He then said "I already refunded yours and Adam's money", the he got beligerent and hung up on me.

I don't think you will get your money. But as you said he is still guilty of fraud either way. I can't wait for him to go down. He has some nerve talking **** to you on the phone and hanging up. If you call when he is not there and get his parents I'll bet his tone will change real fast.
